8.44.010 Definitions.

For the purposes of the ordinance codified in this chapter, the following terms, phrases, words, and their derivations shall have the meaning given in this section. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number, and words in the singular number include the plural number. “Shall” is always mandatory and not merely directory.

“City” means the city of Ritzville.

“Deviating truck” means a truck which leaves and departs from the designated truck route while traveling inside the city.

“Person” means any person, firm, partnership, association, corporation, company or organization of any kind.

“Truck” means any vehicle designed or operated for the transportation of property that exceeds the maximum width of eight feet, six inches and maximum height of 14 feet. Legal weight is anything not exceeding 40,000 pounds for single unit, 80,000 pounds for combination units, 20,000 pounds for single axle, 34,000 pounds for tandem axle.

“Truck route” means a way over certain streets, as designated in this section, over and along which trucks coming into and going out of the city must operate. (Ord. 961 § 1, 1998).

8.44.020 Application of regulation.

All oversize trucks within the city shall be operated only over and along the oversize truck routes established in this chapter and on the other designated streets over which oversize truck travel is permitted. (Ord. 961 § 2, 1998).

8.44.030 Oversized truck route established.

There is established within the city, the following oversize truck route: Traffic heading east shall use First Avenue east to Danekas Road; traffic heading west shall use First Avenue east to Division Street, then north on Division Street to Rosenoff Road or such temporary routes as established. (Ord. 961 § 3, 1998).

8.44.040 Street use permit authorized.

The clerk/treasurer or designee is authorized to issue a permit for travel of oversized trucks based on a finding that the public purpose is served by doing so. There shall be a fee imposed to cover the cost of administering the permit. The following sections of the Revised Code of Washington as now or hereafter amended are adopted by reference as part of this chapter in all respects as though such sections were set forth in this chapter in full: RCW 46.44.0941. 8.44.050 Maps.

The city clerk/treasurer shall keep and maintain accurate maps setting oversize truck routes and streets upon which truck traffic is permitted; the maps shall be kept on file in City Hall. (Ord. 961 § 5, 1998).

8.44.060 Signs.

The public works director and chief of police, as per model traffic ordinance, shall cause all truck routes to be clearly posted to give notice that this chapter is in effect in conjunction with agreements with Adams County and/or the state of Washington. (Ord. 961 § 6, 1998).

8.44.070 Violation – Penalty.

Any person operating a deviating truck shall be cited. Violation of or failure to comply with any provisions of this chapter shall be punishable by RCW 46.44.105 as now or hereafter amended. (Ord. 961 § 7, 1998).
