1-6-1 PERSONNEL POLICY MANUAL:

A.    The mayor and/or designee shall be responsible for the administration, revision, updating and circulation of the Roy personnel policy manual (PPM) adopted by the Roy city council (council) by ordinance 622, September 24, 2001.

B.    In administration of updating of the PPM, the mayor shall be guided by best personnel practices as are suitable to the city of Roy, by fair and equitable treatment of personnel, and by the requirements of all federal, state, and local laws, rules, regulations and policies.

C.    Where a direct conflict exists with other personnel policies, the PPM shall control unless otherwise provided in the PPM.

D.    The mayor shall present a quarterly report to the council at the first regularly scheduled meeting of January 2011, and each such meeting every three (3) months thereafter. By motion of the council at any lawful meeting of the council, the council may direct the mayor to revise or amend any provision or provisions of the PPM and return within a time specified with modified provision(s).

E.    Any employee who objects to the adoption of a provision of the PPM within a reasonable time period after notice of changes or additions to the PPM shall be afforded the right to file a written complaint thereof pursuant to a PPM procedure established by the mayor, to include final appeal to the council. This subsection does not apply to subsequent interpretation and personnel actions based upon any PPM provision.

F.    The mayor shall devise and publish such rules and regulations as necessary to accomplish the directives, spirit and intent of this section. (Ord. 843, 10-11-2010)

1-6-2 APPOINTIVE OFFICERS AND EMPLOYEES:

A.    Appointive Officials Enumerated: Appointive officials shall include, but shall not be limited to: city clerk-treasurer, chief of police, city attorney and municipal court judge. (Ord. 215, 10-9-1978, eff. 10-9-1978; amd. 2006 Code)

B.    Authority To Make Appointments: The mayor shall have the authority to appoint all of said appointive officers. The office of municipal judge shall be approved by the city council as per Revised Code Of Washington 3.50.040, and city ordinance 971. (Ord. 153, 9-13-1971; amd. 2006 Code)

C.    Confirmation Of Appointments: Confirmation of all mayoral appointments by the city council shall be by the affirmative vote of a majority of the total membership of the city council. (Ord. 271A, 10-12-1981)

D.    Qualifications Of Appointees: All appointments of city officers and employees shall be made on the basis of ability and training or experience of the appointees in the duties they are to perform. (Ord. 215, 10-9-1978, eff. 10-9-1978)

E.    Duties Of Officers: The duties of said officers shall be as prescribed by Revised Code of Washington chapter 35A.42 and city ordinance 971.

F.    Compensation: The compensation of said officers shall be determined by the city council as set forth annually in a budget ordinance. Such compensation shall be no less than the prevailing minimum wage, in accordance with state and federal law. (Ord. 712, 5-9-2005)

G.    Removal Or Dismissal, Council Approval: Removal or dismissal of all appointed officers or employees shall require the affirmative vote of a majority of the total membership of the city council. (Ord. 271A, 10-12-1981)

1-6-4 LEGAL HOLIDAYS:

A.    Holidays Established: The following holidays are adopted as legal holidays for the city:

    If any of the above specified legal holidays for the city are also federal legal holidays but observed on different dates, only the city legal holidays shall be recognized as paid legal holidays for employees of the city.

B.    Holidays Falling On Saturday Or Sunday: Any holiday falling on Saturday will be celebrated on the preceding Friday. Any holiday falling on Sunday will be celebrated on the following Monday.

C.    Employees of the city shall be entitled to one (1) unpaid holiday per calendar year in addition to those specified in this section. Each employee of the city may select the day on which the employee desires to take the additional holiday provided for herein after consultation with the employer pursuant to guidelines to be promulgated by the mayor and set forth in the Roy personnel policy manual, and expressly adopted by resolution of the Roy city council.

D.    Employees of the city shall be entitled to two (2) unpaid holidays per calendar year for a reason of faith or conscience or for an organized activity conducted under the auspices of a religious denomination, church, or religious organization. The employee may select the days on which the employee desires to take the two (2) unpaid holidays after consultation with the employer pursuant to guidelines promulgated by the mayor and set forth in the Roy personnel policy manual, and expressly adopted by resolution of the Roy city council. If an employee prefers to take the two (2) unpaid holidays on specific days for a reason of faith or conscience, or an organized activity conducted under the auspices of a religious denomination, church, or religious organization, the employer must allow the employee to do so unless the employee's absence would impose an undue hardship on the employer or the employee is necessary to maintain public safety. Undue hardship shall have the meaning established by the Washington State Office of Financial Management (OFM) pursuant to its rule-making process. (Ord. 514, 12-9-1996; Sub. Ord. 911, 6-9-2014)

1-6-5 TRAVEL REIMBURSEMENT:

Travel on official business outside the city by a single individual employee should be via public carrier or city owned vehicle; however, if a private vehicle is used, mileage shall be paid at the rate per mile currently allowed by the internal revenue service. (Ord. 513, 12-9-1996)

1-6-6 WORKING HOURS; CITY HALL HOURS:

A.    Clerk-Treasurer: The city clerk-treasurer will work forty (40) hours per week, with hours to be scheduled by the mayor.

B.    General Maintenance And Water System Personnel: General maintenance and water system personnel will work forty (40) hours per week, with hours to be scheduled by the mayor.

C.    Police Department: Police department hours will vary in order to provide service when needed, and will be scheduled by the chief of police.

D.    Municipal Court Clerk: The hours of the municipal court clerk shall be established by the municipal judge.

E.    Part Time And Temporary Employees: Part time and temporary employees will work hours as specified by the mayor.

F.    The City Hall office will be open from seven thirty (7:30) A.M. until five o’clock (5:00) P.M., Monday, Tuesday, Wednesday, and Thursday. Occasionally, it will be necessary to close the office temporarily for meal breaks or in order to attend to city business.

G.    The City Hall office will allow viewing of historical documentation from seven thirty (7:30) A.M. until five o’clock (5:00) P.M., Monday, Tuesday, Wednesday, and Thursday with a limit of two (2) guests per viewing which must be scheduled with the city clerk-treasurer in conjunction with available staff or volunteer schedules. Occasionally it may be necessary to deny requests due to staff shortages, training, or facility scheduling conflicts.
