1-7-1 DECLARATION OF CANDIDACY:

A candidate who desires to have his or her name printed on the ballot for election to a city office shall complete and file a declaration of candidacy on a form prescribed by the city. (Ord. 714, 5-9-2005)

1-7-2 FORM OF DECLARATION:

A.    Required Information: Included on the declaration form shall be:

1. A place for the candidate to declare that he or she is a registered voter within the jurisdiction of the office for which he or she is filing, and the address at which he or she is registered.

2. A place for the candidate to indicate the position for which he or she is filing.

3. A place for the candidate to indicate a party designation, if applicable.

4. A place for the candidate to sign the declaration of candidacy, stating that the information provided on the form is true and swearing or affirming that he or she will support the constitution and laws of the United States and the constitution and laws of the state of Washington.

B.    Other Information: The city may require any other information on the form deemed appropriate to facilitate the filing process. (Ord. 714, 5-9-2005)

1-7-3 TIME FOR FILING:

Declarations of candidacy for the following offices shall be filed with the Pierce County auditor during regular business hours no earlier than the fourth Monday in July and no later than the following Friday in the year in which the office is scheduled to be voted upon:

A.    Offices that are scheduled to be voted upon for full terms or both full terms and short terms at, or in conjunction with, a state general election; and

B.    Offices where a vacancy, other than a short term, exists that has not been filled by election and for which an election to fill the vacancy is required in conjunction with the next state general election. (Ord. 723, 5-23-2005)

1-7-4 FILING FEES:

The following filing fees shall accompany the declaration of candidacy:

A.    Ten dollars ($10.00), for any office with a fixed annual salary of one thousand dollars ($1,000.00) or less.

B.    A filing fee equal to one percent (1%) of the annual salary of the office at the time of filing, for any office with a fixed annual salary of more than one thousand dollars ($1,000.00) per annum.

C.    No filing fee need accompany a declaration of candidacy for any office for which compensation is on a per diem or per meeting attended basis.

D.    The fee shall be paid to the Pierce County auditor who shall transmit it to the city clerk-treasurer for deposit in the city treasury.

E.    A candidate who lacks sufficient assets or income at the time of filing to pay the required filing fee shall submit with his or her declaration of candidacy a nominating petition. The petition shall contain not less than a number of signatures of registered voters equal to the number of dollars of the filing fee. The signatures shall be of voters registered to vote within the jurisdiction of the office for which the candidate is filing. (Ord. 714, 5-9-2005)
