2-1-1 AUTHORITY TO PLAN:

The authority of the city to engage in planning and implementation of planning is derived from article XI, sections 10 and 11 of the state constitution and is in accordance with the optional municipal code. (Ord. 219, 5-14-1979)

2-1-2 COMMISSION ESTABLISHED:

There is hereby established a planning commission, hereinafter referred to as the commission. (Ord. 219, 5-14-1979)

2-1-3 MEMBERSHIP:

A.    Membership Regulations:

1. The commission shall consist of three (3) members, all of whom shall serve without compensation.

2. No member of the commission shall be an elected official of the city or an employee of the city.

3. A member need not be a resident of the city.

4. The members shall be appointed by the mayor and confirmed by the council.

5. The term of each member shall be four (4) years.

6. The present members of the planning commission shall continue to serve until the expiration of their current terms.

B.    Specific Positions: The positions of the planning commission shall be numbered 1 through 3, and all appointments shall be made to a specific position.

C.    Filling Vacancy: Any vacancy occurring on the planning commission shall be filled in the same manner as the original appointment, and the appointment shall be for the remainder of the unexpired term.

D.    Removal; Hearing: Members may be removed, after a public hearing, by the mayor for inefficiency, neglect of duty, conflict of interest or malfeasance in office. A public hearing is not required when a member fails to timely complete training required by the state of Washington or by the city’s insurance provider. (Ord. 456, 4-11-1994; Ord. 941, 7-11-2016)

2-1-4 ORGANIZATION, MEETINGS AND RECORDS:

A.    Rules: The commission shall adopt its own rules of procedures, and such rules shall be of public record.

B.    Meetings: The commission shall hold at least one regularly scheduled meeting each month. Additional meetings may be called when deemed necessary by the chairman of the commission. All meetings shall be open to the public.

C.    Written Records; Secretary:

1. Written records of meetings, resolutions, transactions, findings, and determinations shall be kept and such records shall be public.

2. A secretary shall be provided by the office of planning to prepare minutes, keep records and perform other duties as prescribed by the commission. (Ord. 219, 5-14-1979)

2-1-5 RESPONSIBILITIES:

A.    Comprehensive Plan:

1. The commission has the responsibility for the preparation and maintenance of the comprehensive plan of the city. The comprehensive plan should provide goals, policies and guidelines for orderly development of the city to provide a healthy and safe environment for the people of Roy. The comprehensive plan must include, but not be limited to: a) conservation; b) open space, park and recreation; c) transportation; d) public buildings and uses; e) public utilities; f) redevelopment plans; g) urban design; and h) other elements that either the commission or the council deems necessary to the plan.

2. The maintenance of the plan is to keep it current and responsive to the needs of the citizens as a whole.

3. The commission has the duty to provide implementation measures to assure compliance with the comprehensive plan. These measures shall include zoning ordinances, subdivision regulations, and any other rules, actions, or regulations deemed necessary to implement the plan.

B.    Hearings; Study Groups: The commission has the responsibility of holding public hearings and inviting public comments and response. To that end the commission is empowered to organize citizen groups for study and reaction to proposed plans and studies, and engage in any activity that will aid and assist in increasing public awareness and response.

C.    Cooperation With Other Agencies: The commission is authorized and empowered to cooperate with other commissions and public agencies of the city, county, state or federal governments in planning, conservation and development. (Ord. 219, 5-14-1979)

2-1-6 RELATION TO COUNCIL AND STAFF:

The commission shall be advisory only and may communicate directly with the council. (Ord. 219, 5-14-1979)

2-1-7 CARRYOVER PROVISIONS:

The commission shall have jurisdiction over all matters previously the business of the land use commission. Wherever the term "planning commission" or "land use commission" appears in any ordinance, or this city code, it shall be deemed to mean planning commission. (Ord. 219, 5-14-1979)
