8-5-1 FACILITIES COORDINATOR:

The city clerk-treasurer shall serve as the facilities coordinator. (Ord. 854, 7-11-2011)

8-5-2 RENTAL APPLICATION AND AGREEMENT FOR USE:

A.    Application And Agreement Form: Prior to the use of the facilities of the community center, an application must be made and an agreement signed on the rental application and agreement form provided by the city. The applicant’s proof of liability insurance coverage in an amount of at least one million dollars ($1,000,000.00) naming the city of Roy as additional insured shall accompany and be made a part of the rental application and agreement form. B.    Information: All information requested on the rental application and agreement must be provided in detail by a responsible representative of the group requesting use of the facilities.

C.    Approval; Signature: The facilities coordinator or a designated representative shall sign the application and agreement indicating that the requested dates are available and that the intended use is approved.

D.    Time For Filing: The application and agreement for reservation may be made a maximum of six (6) months prior to desired date. (Ord. 854, 7-11-2011)

8-5-3 USE APPROVAL GUIDELINES; REGULATIONS:

Guidelines for approval of the community center are as follows:

A.    Discrimination: The use of the facilities may not be restricted on the basis of race, sex, religious affiliation, national origin, political affiliation or any other protected class under federal, state or local law.

B.    Activities Limited: Proposed use will be limited to activities such as meetings, reunions, dinners, and receptions taking place inside the community center.

C.    Scheduling Of Dates: The scheduling of dates for the usage of the facilities will be the responsibility of the facilities coordinator.

D.    City Right To Reject Application: The facilities coordinator may reject any application if, in his/her judgment, the anticipated use would not comply with the letter, spirit or intent of this chapter.

E.    State Or County Agencies And Nonprofits:

1. State or county agencies and nonprofits may be allowed to use the community center facilities for an exchange of beneficial services or products in lieu of the rental fee.

2. Said groups shall not be exempt from the responsibilities of damage or cleaning; however, they shall not be required to pay a damage or reservation deposit unless designated by the facilities coordinator based on the nature of the event.

F.    Revocation Or Cancellation Of Agreement: The city, in support of the facilities coordinator, reserves the right to revoke or cancel any agreement and to refund any payment made for the use of facilities where it is deemed such revocation is in the best interests of the city. Applicant will be given prompt notice of cancellation. (Ord. 854, 7-11-2011)

8-5-4 FEES; ATTENDANT:

A.    Fees Established: The rental fee and deposits for the community center are as follows:

Reservation deposit

Damage deposit

B.    Attendant: The city may provide an attendant to be present during the required period. The cost of the attendant is included in the rental fee. (Ord. 854, 7-11-2011)

8-5-5 DAMAGE/RESERVATION DEPOSIT; CONDITIONS:

A.    Payment; Cancellation; Refund: Damage/reservation deposits as set forth in this chapter are payable at the time of the application. Cancellation of the facilities rental agreement with fewer than fourteen (14) days’ written notice shall result in a forfeiture of the reservation deposit, balance to be returned in approximately three (3) weeks.

B.    Written Notice Of Cancellation: The reservation may be canceled by giving a written notice to the city fourteen (14) days prior to the date of the scheduled event.

C.    Nonliability Of City: The city shall not be liable for injuries or loss of property or vandalism resulting from use of premises or the adjacent parking areas. (Ord. 854, 7-11-2011)

8-5-6 RULES AND REGULATIONS FOR USE:

A.    Basis For Approving Applications: Applications for use of the community center will be approved on a first come, first served basis upon completion of all prerequisites set forth herein subject to the limitations of this chapter.

B.    Hours Of Use: Use of the community center will normally be allowed Sunday through Thursday from eight o’clock (8:00) A.M. to eleven o’clock (11:00) P.M. and Friday and Saturday from eight o’clock (8:00) A.M. to twelve o’clock (12:00) midnight.

C.    Number In Attendance: Occupancy is limited to the number posted by the fire marshal.

D.    Special Equipment: Special equipment needed must be provided by the user.

E.    Cleaning Of Facilities:

1. All cleaning of the facilities is the responsibility of the applicant and the facilities must be left in the same condition in which they were found inside the building and on the adjacent grounds or any parking utilized by the applicant or guests of the applicant.

2. Applicants are required to remove, at their expense, all materials, equipment, furnishings or rubbish left after use of the facility.

3. The damage deposit will be retained until all items are removed. If no damage is incurred, if all items are removed and if the building is clean, the deposit will be returned to the applicant within approximately three (3) weeks; provided, however, that if the renter leaves items behind, incurs damage or leaves the facilities or adjacent parking areas dirty, littered, obstructed or otherwise not suitable for an event scheduled after the renter’s event, the deposit shall not be returned and damages to the city and to any subsequent renter shall be assessed by the mayor.

F.    Alcohol Prohibited: No alcohol shall be allowed in the community center.

G.    Smoking Prohibited: No smoking shall be allowed in the community center1. (Ord. 854, 7-11-2011)

8-5-7 REMEDIES PERMITTED:

Nothing set forth in this chapter shall prevent the city from pursuing any and all remedies permitted by law in the case of violation of the requirements of this chapter or the agreement of the parties or from any misrepresentation on an application. (Ord. 854, 7-11-2011)
