MODEL TRAFFIC ORDINANCE

Pursuant to RCW 36.32.120(7) the Washington Model Traffic Ordinance, cited as Chapter 46.90 RCW, is adopted by reference as and for the traffic ordinance of the County with the same effect as if fully set forth in this section, except as provided in SJCC 10.04.020 and 10.04.030. 10.04.020 Sections not adopted.

The following sections of the Washington Model Traffic Ordinance are not adopted and are expressly deleted: 46.90.142, 46.90.145, 46.90.148, 46.90.172, 46.90.210, 46.90.250, 46.90.255, 46.90.475, 46.90.500, 46.90.505, 46.90.510, 46.90.515, 46.90.520, 46.90.525, 46.90.530, 46.90.535, 46.90.540, 46.90.560, 46.90.600, 46.90.610, 46.90.620, 46.90.630, 46.90.640, 46.90.650, 46.90.660, 46.90.710. 10.04.030 Other provisions not adopted.

A. The following provisions of the Washington Model Traffic Ordinance are not adopted by the County: RCW 46.90.265(15), (20) and (21) and RCW 46.90.270(6).

B. The following statutes, adopted by reference by the Washington Model Traffic Ordinance and made a part thereof, are not adopted by the County: RCW 46.12.070, 46.12.080, 46.12.101, 46.12.260, 46.61.085, 46.61.340, 46.61.345, 46.61.350 and 46.61.355. 10.04.040 Violation – Penalty.

Unless another penalty is expressly provided by law, any person who is convicted of violating or failing to comply with any of the provisions of this chapter shall be punished by a fine of not more than $250.00. (Res. 39-1976. Formerly 10.20.040)

10.04.050 Disposition of fines and forfeitures.

All fines or forfeitures collected upon conviction or upon the forfeiture of bail of any person charged with a violation of any of the provisions of this chapter shall be paid into the general fund of the County. (Res. 39-1976. Formerly 10.20.050)
