CONTRIBUTIONS TO CITY—RESTRICTIONS AND CONDITIONS

2.96.010 Acceptance guidelines.

A.    The city financial officer may accept all unrestricted and unconditional donations of money to the city, which shall be deposited in the general fund.

B.    The city financial officer may accept donations of money to the city which are for a restricted use or are conditional, only with prior approval of the city council; provided, these donations may be received and held pending such approval when, in the judgment of the financial officer, it is in the best interests of the city to do so.

C.    Donations of “in kind” goods and services may be accepted by city officers only with prior city council approval; provided, these donations may be received and held pending such approval, when, in the judgment of the appropriate officer, it is in the best interests of the city to do so.

D.    This section shall not prohibit the appropriate city officers from accepting donations without city council approval from community service organizations or individuals of money, goods, or services for existing programs which have previously been formally established by the city, including, for example, such programs as the D.A.R.E. program, contributions from Friends of the Library to the library summer reading program, contributions of labor, goods, or money, toward park improvements, the Senior Center, and Community Center, and like donations which supplement existing city services and programs.

E.    It is not the intent of this section to set strict rules to govern the acceptance of donations. Rather, this section outlines the procedure and standards by which the city council expects to be consulted regarding such donations. The formality of consultation will depend upon the nature of the donation. The consent of the council may be inferred from informal notice and discussion, or may be formal and specific depending upon the nature of the donation.

F.    This chapter shall not apply to donations, gifts or loans which are governed by Chapter 2.92. (Ord. 1270-96 § 1, 1996)
