12.12.010 Ditches and culverts subject to regulations.

All ditches and culverts crossing the public streets or alleys of the city must conform to the regulations prescribed in this chapter; however, nonconforming ditches now in use and running across streets or alleys are exempt until such time that they must be altered or repaired to prevent flooding or damage to property. 12.12.020 Application to construct – Standards.

Parties desiring to have a ditch or culvert run across or under a public right-of-way must apply for and receive a city right-of-way permit before any such construction begins. The ditch and/or culvert must be designed and constructed to city standards and specifications and be designed to prevent flooding or damage to property. (Ord. 2024-003 § 1 (Exh. 12.12.030 General provisions.

A. The applicant is responsible for all costs of construction of ditches and/or culverts.

B. All ditches and/or culverts must be maintained and kept in good repair by the irrigation district/company, or the owner.

C. If any ditch crossing or culvert becomes defective and needs repairs or alteration to prevent flooding or property damage, the city’s public works director or designee will notify the irrigation district, company, or owner in possession or control of the ditch and/or culvert in accordance with Chapter 1.13 SMC, Code Enforcement, and Chapter 8.04 SMC, Nuisances, as applicable.
