AMENDMENTS TO THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS (UCADB)

18.16.010 Amendment to UCADB Section 103.

Section 103 of the UCADB is amended to read as follows:

103. All buildings or structures which are required to be repaired under the provisions of this code shall be subject to the provisions of Section 3403 of the International Building Code, and International Existing Building Code as adopted by the City of Shelton.

18.16.020 Amendment to UCADB Section 205.1.

Section 205.1 of the UCADB is hereby repealed and a new Section 205.1 is hereby added, to read as follows:

205.1 Appeals. The hearings examiner shall hear appeals of any notice and order of the building official pertaining to any violations defined in UCADB Section 203. Appeals to the hearings examiner shall be processed in accordance with the provisions contained in Section 501 of this code.

18.16.030 Amendment to UCADB Section 205.2.

Section 205.2 of the UCADB is amended to read as follows:

205.2 Limitations of Authority. The board of appeals hearings examiner shall have no authority relative to interpretation of the administrative provisions of this code, nor shall the examiner be empowered to waive requirements of this code.

18.16.040 Amendment to UCADB Section 301.

Section 301 of the UCADB is amended to read as follows:

SECTION 301—GENERAL

For the purpose of this code, certain terms, phrases, words and their derivatives shall be construed as specified in either this chapter or as specified in the building Code or the Housing Code. Where terms are not defined, they shall have their ordinary accepted meanings within the context with which they are used. Webster’s Third New International Dictionary of the English Language, Unabridged, copyright 1986, shall be construed as providing ordinary accepted meanings. Words used in the singular include the plural and the plural the singular. Words used in the masculine gender include the feminine and the feminine the masculine.

BUILDING CODE is the International Building Code promulgated by the International Code Council as adopted by the City of Shelton.

BUILDING OFFICIAL is the building official of the City of Shelton or his/her authorized representative.

DANGEROUS BUILDING is any building or structure deemed to be dangerous under the provisions of Section 302 of this code.

HOUSING CODE is the Uniform Housing Code promulgated by the International Conference of Building Officials, as adopted by this jurisdiction.

18.16.050 Repeal of UCADB Chapter 4.

Chapter 4 of the Uniform Code for the Abatement of Dangerous Buildings (UCADB) is hereby repealed. (Ord. 1724-0108 § 10, 2008)

18.16.060 Repeal of UCADB Chapter 5.

Chapter 5 of the Uniform Code for the Abatement of Dangerous Buildings (UCADB) is hereby repealed. (Ord. 1724-0108 § 11, 2008)

18.16.090 Repeal of UCADB Chapter 6.

Chapter 6 of the Uniform Code for the Abatement of Dangerous Buildings (UCADB) is hereby repealed. (Ord. 1724-0108 § 14, 2008)

18.16.100 Repeal of UCADB Chapter 7.

Chapter 7 of the Uniform Code for the Abatement of Dangerous Buildings (UCADB) is hereby repealed. (Ord. 1724-0108 § 15, 2008)

18.16.110 Amendment to UCADB Section 801.1.

Section 801.1 of the UCADB is hereby amended to read as follows:

801.1 Procedure. When any work or repair or demolition is to be done pursuant to SMC Section 17.08.006 the Community & Economic Development Director shall issue an order therefor to the director of public works and the work shall be accomplished by personnel of this jurisdiction or by private contract under the direction of said director, or the Community & Economic Development Director may employ such architectural and engineering assistance on a contract basis as may be deemed reasonably necessary. If any part of the work is to be accomplished by private contract, standard public works contractual procedures shall be followed.

18.16.120 Amendment to UCADB Section 901.

Section 901 of the UCADB is hereby amended to read as follows:

Section 901—ACCOUNT OF EXPENSE, FILING OF REPORT

The director of public works shall keep an itemized account of the expense incurred by this jurisdiction in the repair or demolition of any building done pursuant to the provisions of SMC Section 17.08.006. Upon the completion of the work or repair or demolition, said director shall prepare and file with the clerk of this jurisdiction a report specifying the work done, the itemized and total cost of the work, a description of the real property upon which the building or structure is or was located, and the names and addresses of the persons entitled to notice pursuant to SMC Section 17.08.006.
