AMENDMENTS TO THE INTERNATIONAL FIRE CODE (IFC)

18.24.010 Amendment to IFC Section 108.

IFC Section 108 is hereby repealed, and a new Section 108 is adopted to read as follows:

SECTION 108

APPEALS

Appeals from any notice and order of the fire official under this code pertaining to violations shall be processed pursuant to SMC Section 17.08.024. Appeals from any notice and order of the fire official under this code pertaining to alternate methods and materials must be submitted according to the provisions of SMC Section 18.05.035.

18.24.020 Amendment to IFC Section 109.

IFC Section 109 is hereby repealed, and a new Section 109 is adopted to read as follows:

SECTION 109

VIOLATIONS

109.1 Notice of Violations. Violations of this code shall be processed in accordance with the provisions of SMC Chapter 17.08.

109.2 Violation penalties. Persons who shall violate a provision of this code, fail to comply with any of the requirements thereof or erect, install, alter or repair work in violation of the approved construction documents or directive of the code official, or of a permit or certificate issued under the provisions of this code, shall be guilty of a civil offense as described in SMC Section 17.08.008, unless otherwise deemed a criminal offense under the provisions of SMC Section 17.08.010.

18.24.030 Amendment to IFC Section 111.4.

IFC Section 111.4 is hereby repealed, and a new Section 111.4 is adopted to read as follows:

111.4 Failure to comply. Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe conditions, shall be guilty of a misdemeanor and subject to criminal penalties described in SMC Section 17.08.010.

18.24.040 Amendment to IFC Section 110.

IFC Section 110 is hereby repealed, and a new Section 110 is adopted to read as follows:

SECTION 110

UNSAFE BUILDINGS

110.1 Unsafe Conditions. Structures or existing equipment that are or hereafter become unsafe or deficient because of inadequate means of egress or which constitute a fire hazard, or are otherwise dangerous to human life or the public welfare, or that involve illegal or improper occupancy or inadequate maintenance, shall be deemed an unsafe condition. Abatement of unsafe structures or equipment shall proceed as defined in SMC Chapter 17.08.

110.2 Evacuation. The fire code official or the fire department official in charge of an incident shall be authorized to order the immediate evacuation of any occupied building deemed unsafe when such building has hazardous conditions that present imminent danger to building occupants. Persons so notified shall immediately leave the structure or premises and shall not enter or re-enter until authorized to do so by the fire code official or the fire department official in charge of the incident.
