9.28.010 Igniting, firing or discharge restricted.

The ignition, firing, discharge or activating of any fireworks, including “consumer fireworks” as defined in Chapter 70.77 RCW, is prohibited within the city limits, except when undertaken as an advertised public display by a competent organized group, which public display must be approved prior to the display in writing by the fire chief. 9.28.020 Sale restricted.

The sale by any person, firm or organization of any fireworks within the city limits is prohibited. (Ord. 1317 § 1, 2021; Ord. 1307 § 1, 2020; Ord. 1214 § 1, 2015; Ord. 984 § 1, 2003; Ord. 538 § 2, 1978).

9.28.030 Prohibition due to extreme fire danger.

Effective July 1, 2016, during periods of extreme fire danger, the city fire chief, public safety officer, or designee may prohibit the discharge of all fireworks. This decision will be based on consultation with the representatives of the county fire districts, county departments, and any other state, federal or local agency with relevant information on weather, fire, environmental, or other related conditions. The fire chief shall provide public notice of any such prohibition, including the effective dates thereof, through dissemination to the local media, posting on the city website, and posting at the local post office and City Hall. 9.28.040 Violation – Penalties.

Every person who violates any of the provisions of this chapter shall have committed a code infraction and shall be punished by a payment of a C-5 civil penalty for each separate offense. Each discharge of an illegal firework constitutes a separate violation. If any violation is continuing, each day’s violation shall be deemed as a separate violation.

In addition, violation(s) of any of the provisions of this chapter or any of the conditions imposed upon a permit issued hereunder shall subject the permit to suspension or revocation, as provided herein. (Ord. 1307 § 1, 2020; Ord. 1214 § 1, 2015).

9.28.050 Discharge of aerial fireworks prohibited.

It shall be unlawful to discharge anywhere within the city limits any of the following fireworks, notwithstanding the inclusion of any of such fireworks within the definition of “common fireworks” as defined by Chapter 70.77 RCW and regulations issued by the State Fire Marshal: those listed in WAC 212-17-035(2), Aerial device, paragraphs (a) through (c), and in WAC 212-17-035(3), Combination items, and aerial (flying) bees. 9.28.060 Consumer fireworks prohibited.

The use of consumer fireworks in the city is prohibited. No consumer fireworks may be used or discharged within the city regardless as to date, time, event, or location. (Ord. 1330 § 2, 2022; Ord. 1307 § 1, 2020).
