16.36.010 Installation of utilities required.

The final subdivision plat requirements of the city provide that water mains, streets, sewer mains and storm drains must be installed at the expense of the subdividers. In connection with the installation of water mains, streets, sewer mains, and storm drains, subdividers are required to extend existing streets and utilities to the property being subdivided. Extensions of water mains, streets, sewer mains, and storm drains may be required to be extended through, or adjacent to, real estate owned by third parties. (Ord. 1017-A § 2, 2005).

16.36.020 General reimbursement procedure.

State law provides a means by which the subdivider may enter into a contract with the city for the reimbursement of a portion of those costs. The costs of public hearings, engineering reviews and approvals incurred by the city in creation of that reimbursement capability shall be borne by the subdivider. (Ord. 1017-A § 2, 2005).

16.36.030 Subdivider’s requirements.

Where the subdivider is required to install streets or utilities through or adjacent to property undeveloped or not subdivided and owned by others, a written statement requesting future reimbursement for improvements, requesting consideration of a contract for such purposes as provided by state law and a certified copy of costs shall be filed with the city engineer. The city engineer will then define the total area subject to reimbursement fees and will cause the provisions of state law to be applied to the request. Following the required notices and hearings, the city engineer may establish a front foot or square foot cost to be paid the subdivider prior to any future building, subdividing or other improvements on property abutting the subdivider installed streets or utilities.
