ABUSE OF 911 EMERGENCY REPORTING SYSTEMS

9.30.010 Abuse of 911 emergency reporting systems.

A. Every person who knowingly calls a 911 emergency reporting system for a purpose other than to report a situation that requires prompt service in order to preserve or protect human life or health or property commits abuse of 911 emergency reporting systems.

B. No person shall be cited under this chapter unless the person has on a previous occasion engaged in prohibited conduct and been notified by a law enforcement officer that the conduct violated this chapter, and the person having been given an opportunity to comply has repeated the unlawful conduct. Under such circumstances the person commits unlawful conduct, and a law enforcement officer may then issue a citation under this section.

C. It is the intent of the city of South Bend city council that persons with diagnoses of mental illness, and who are charged under this section, be referred to mental health services to address behaviors which violate this section. (Ord. 1491, 2014).

9.30.020 Violation – Penalty.

Abuse of 911 emergency reporting systems is a simple misdemeanor, and shall be punishable by no more than 90 days in jail and a $1,000 fine. (Ord. 1491, 2014).
