DRIVING UNDER THE INFLUENCE

10.25.010 First offense.

Every person who is convicted of a violation of RCW 46.61.502 or 46.61.504 shall be punished by imprisonment for not less than 24 consecutive hours nor more than one year, and by court costs or fine or combination thereof of not less than $350.00 or more than $750.00. (Ord. 1087 § 1, 1984).

10.25.020 Second or subsequent convictions.

On a second or subsequent conviction for driving or being in physical control of a motor vehicle while under the influence of intoxicating liquor and/or drugs within a five-year period a person shall be punished by imprisonment for not less than seven days or more than one year and by court costs or fine or combination thereof of not less than $500.00 or more than $1,500. (Ord. 1087 § 2, 1984).

10.25.030 Suspension or deferral.

None of the above penalties and imprisonment may be deferred or suspended. (Ord. 1087 § 3, 1984).

10.25.040 Other requirements.

For each of the above offenses, the offender shall be required to attend Alcohol Information Service (AIS) or such other program as deemed appropriate by the court. (Ord. 1087 § 4, 1984).
