15.06.010 City council – Powers and duties.

In addition to the powers and duties described in SBMC Title 16, Zoning, and other documents adopted by reference in this title, the city council is vested with the authority to:

A. Approve, approve with conditions, or deny applications for short subdivisions, preliminary plat approval, final plat approval, and amendments to this title;

B. Decide local appeals of the decisions that the planning commission has made regarding boundary line adjustments and conditional use permits;

C. Base all decisions on criteria established in this title or other applicable laws;

D. Require any applicant granted final plat approval or site plan approval to deposit an acceptable security with the city and sign a security agreement to assure that the applicant and/or his successors in interest will adhere to the approved plan and all conditions attached to the final plat approval or site plan approval;

E. Review and act upon any recommendations of the city supervisor or planning commission for amendments to the provisions of this title;

F. Perform other duties as outlined in this title. (Ord. 1222 § 1, 1997).

15.06.020 Board of adjustment – Powers and duties.

A. The powers and duties of the board of adjustment are outlined in SBMC Title 16, Zoning.

B. The board of adjustment has the authority to hear and decide on applications for variances.

C. The board of adjustment has the authority to hear and decide on appeals from administrative decisions. (Ord. 1222 § 1, 1997).

15.06.030 Planning commission – Established – Meetings – Rules.

The planning commission of the city of South Bend is established by Chapter 2.15 SBMC. Chapter 2.15 SBMC and the bylaws and rules of procedure adopted pursuant to that chapter, as they now exist or will later be amended, are hereby adopted by reference. (Ord. 1222 § 1, 1997).

15.06.040 Planning commission – Powers and duties.

In addition to the powers and duties outlined in Chapter 2.15 SBMC, the bylaws and rules of procedure, SBMC Title 16, Zoning, and other documents adopted by reference in this title, the planning commission has the following authority and duties:

A. Exercising all of the powers of a planning commission as authorized in Chapters 35A.63 and 58.17 RCW and other provisions of state law;

B. Making studies and recommendations to the city council concerning goals, objectives, and policies governing all elements of the comprehensive plan and the provisions of this title regarding development in South Bend’s corporate area and urban growth area;

C. Holding public hearings or reviews on applications for short subdivisions and preliminary plats, considering the testimony of affected individuals, considering the recommendations of the city supervisor, and making recommendations to the city council;

D. Holding public hearings or reviews on applications for (zoning) conditional use permits and shoreline substantial development permits, considering the testimony of affected individuals, considering the recommendations of the city supervisor, and making recommendations to the city council;

E. Reviewing and making a final decision on applications for boundary line adjustments;

F. Performing other duties as outlined in this title. (Ord. 1222 § 1, 1997).

15.06.050 City supervisor – Powers and duties.

A. In addition to the powers and duties outlined in other documents adopted by reference in this title, the city supervisor or his/her designee is vested with:

1. Overall administrative responsibility of this title;

2. Authority to approve, approve with conditions, or deny applications for site plan review.

B. The duties and responsibilities of the city supervisor include:

1. Establishing procedures and preparing forms necessary for the administration of this title;

2. Advising interested citizens and applicants of the regulations and procedures set forth in this title;

3. Making administrative decisions and interpretations of the regulations set forth in this title;

4. Determining that an applicant provides all applications for development and other required materials;

5. Compiling an official file on each application submitted;

6. Reviewing all information submitted by an applicant and preparing a report that summarizes his/her findings, conclusions, and recommendations involving an application;

7. Approving, approving with conditions, or denying applications for permits or approvals listed in subsection (A)(2) of this section;

8. Submitting the report in subsection (B)(6) of this section to the planning commission, board of adjustment, or city council, depending on the application, for consideration and official action. The city supervisor will assure that all relevant information and testimony regarding an application is made available to the planning commission, board of adjustment, and/or city council during their review;

9. Requiring any applicant granted site plan approval or binding site plan approval deposit an acceptable security with the city and sign a security agreement to assure that the applicant or his successors in interest or both will adhere to the approved plan and all conditions attached to the approved site plan;

10. Assuring that proper notice is given to appropriate persons, agencies, and the public for all hearings;

11. Investigating, developing, and proposing amendments to the South Bend comprehensive plan as necessary;

12. Seeking remedies for alleged violations of this title, or of violations of conditions of any permit or approval issued by the city; and

13. Coordinating information with other departments of the city and affected agencies. (Ord. 1222 § 1, 1997).
