PLANNING COMMISSION

2.24.040 Recommendations to council.
2.24.010 Commission created.
Pursuant to the authority conferred by Chapter 35.63 RCW, there is hereby created a city planning commission consisting of six members who shall be selected by appointment, by the city mayor and subsequent confirmation by the city council. One of the six members elected shall be ex officio. (Ord. 943, 1987; Ord. 660 § 1, 1968: Ord. 579 § 1, 1959)
2.24.020 Term of office.
The term of office of the ex officio member shall be for the duration of his tenure in office as councilman. The term of office of the remaining five members appointed by the mayor shall be for three years; provided, however, that the three-year terms shall be staggered so that two members’ terms shall expire each year for two successive years and the term of the one remaining member shall expire on the third year. The mayor shall appoint new members to the planning commission as the terms of the older members expire or are vacated, from time to time. Each three-year term of office shall begin on January 1st of the year following the appointment and confirmation of the new member to the planning commission. Any member appointed to the planning commission prior to January 1st of any year shall be a valid and acting member of the planning commission immediately after confirmation of his appointment by the city council although his three-year term shall not officially begin to run until the 1st of January following his appointment. This section shall not affect the terms of office of the present members of the planning commission who were appointed and confirmed under the Sumas Municipal Code, in effect prior hereto. 2.24.030 Powers and duties.
The planning commission shall have all of the powers and perform each and all of the duties specified by Chapter 35.63 RCW, together with any other duties or authority which may hereafter be conferred upon them by the laws of the state, the performance of such duties and the exercise of such authority to be subject to each and all of the limitations expressed in such legislative enactment or enactments. 2.24.040 Recommendations to council.
The council may refer to the planning commission for its recommendation and report, any law, resolution or other proposal relating to any of the matters and subjects referred to in Chapter 35.63 RCW and the commission shall promptly report to the council thereon, making such recommendations and giving such counsel as it may deem proper in the premises. 2.24.050 Plats submitted.
All plats or plans of subdivisions of land within the town of proposed additions, as well as dedications of streets and alleys, offered to the council for acceptance shall first be submitted to the planning commission for its recommendation and report, which report shall be made to the council within thirty days after submission, or at such earlier date as the council shall direct. 2.24.060 Secretary.
The planning commission may designate one of its members to act as secretary without salary, or if requested by the commission, the mayor shall designate a member of the paid staff of the city to serve as such secretary, who shall serve without additional compensation. (Ord. 579 § 7, 1959)
2.24.070 Meetings—Quorum.
A majority of the membership to the planning commission, not less than three of whom shall be appointed members, shall constitute a quorum for transaction of business. Any action taken by the majority of those present, when a meeting of the planning commission is held, shall be deemed and taken as action of the planning commission. 2.24.080 Report to council.
The planning commission, at or before its first regularization in February of each year, shall make a full report in writing to the council of its transactions and expenditures, if any, for the preceding year, with such general recommendations as to matters covered by its prescribed duties and authority as it may seem proper.
