USE OF CITY-OWNED FACILITIES AND EQUIPMENT

2.96.010 Use of facilities—Procedures.

(1)    There is established the following policy for the usage of city-owned facilities, which shall include the following requirements:

(A)    Any user wishing to reserve and use a city-owned facility must submit a use agreement to the city clerk’s office with payment of the refundable deposit prior to the city staff approving the use agreement. All other user fees must be paid in full at least two weeks prior to the date of use.

(B)    Reservations will be made on a first come, first served basis. If the user agreement is not completed in its entirety or if the deposit payment is neglected to be paid, the user agreement will be rejected, and the requested use period will not be reserved.

(C)    All city-owned facilities shall be returned by the user in the same or as good as condition as when the usage began. All users must schedule a walk-through with city staff to establish a baseline of facility conditions and proper operation of equipment. City staff will inspect the facility after the use period and if there is any damage and/or cleanup, the refundable deposit will be used to reimburse the city for time and expense. Likewise, if the facility was returned in its original condition, the refundable deposit will be returned to the user.

(D)    The city of Sumas will waive any user fees for local nonprofit youth organizations. For the purposes of the use agreement, the city of Sumas recognizes “local” as being any group or person(s) who resides within Nooksack Valley (Sumas, Nooksack or Everson). The city of Sumas also recognizes “youth” as being organizations whose primary participants are twelve years of age or younger. All other nonprofit organizations may submit in writing a petition to have the user fees waived. 2.96.015 Use of facilities—Fees.

(1)    The city council of the city of Sumas has established a fee schedule setting forth user fees for certain city-owned facilities.

(A)    Rodeo Grounds Fees.

Arena Use—Seventy-five dollars per hour or two hundred dollars per day with a refundable deposit of one hundred fifty dollars. The use includes access to the concession stand, arena lights, and the crow’s nest. If the sound equipment is going to be used the refundable deposit fee will increase to five hundred dollars.

Local Nonprofit Youth Events—The user fee is waived for local nonprofit youth events, with a one hundred fifty dollar refundable deposit. The use includes access to the concession stand, arena lights, and the crow’s nest. If the sound equipment is going to be used the refundable deposit fee will increase to five hundred dollars.

Nonlocal or For-Profit Youth Events—Forty dollars per hour or one hundred dollars per day with a refundable deposit of one hundred fifty dollars. The use includes access to the concession stand, arena lights, and the crow’s nest. If the sound equipment is going to be used the refundable deposit fee will increase to five hundred dollars.

Camping—Any camping structure that will be used for the purpose of staying overnight at the Rodeo Grounds during a scheduled event will be charged at a rate of five dollars per night, per structure. A camping structure may include tents, trailers, RVs or the like.

(B)    Ballfield Fees.

Adult League—Forty dollars per game or two hundred twenty-five dollars per team for a maximum of twelve scheduled games. The user fee includes field prep, field lights and access to the concession stand.

Local Nonprofit Youth League—The user fee is waived for the local nonprofit youth league; however, field prep at a rate of fourteen dollars per game will apply.

Nonlocal or For-Profit Youth League—Twenty dollars per game or one hundred seventy-five dollars per team for a maximum of twelve scheduled games. The user fee includes field prep, field lights and access to the concession stand.

Tournament—Two hundred twenty-five dollars per day. The user fee includes field prep, field lights and access to the concession stand.

Field Prep—Fourteen dollars per game.

Camping—Any camping structure that will be used for the purpose of staying overnight at the ballfields during a scheduled event will be charged at a rate of five dollars per night, per structure. A camping structure may include tents, trailers, RVs or the like.

(C)    Community Center Fees.

Community Center Use—Twenty dollars per hour or one hundred dollars per day with a refundable deposit of fifty dollars.

Local Nonprofit Youth Organizations—The user fee is waived for local nonprofit youth organizations, with a fifty dollar refundable deposit.

Nonlocal or For-Profit Youth Organizations—Ten dollars per hour or fifty dollars per day with a refundable deposit of fifty dollars. (Ord. 1816 § 2, 2024)

2.96.020 Use of equipment—Procedures and fees.

(1)    The following are the rates and fees for the use of city of Sumas owned equipment:

(A)    Use of any ladder truck and operator shall be seventy-five dollars per hour.

(B)    Use of backhoe and operator shall be sixty dollars per hour.

(C)    Use of the mower and operator shall be forty dollars per hour. There shall be a minimum half-hour charge for use of the mower.

(D)    Use of the grader/tractor and operator shall be fifty dollars per hour.

(E)    Use of the dump truck and operator shall be sixty dollars per hour.

(F)    Use of the digger derrick truck and operator shall be eighty dollars per hour.

(G)    Use of the jackhammer shall be thirty dollars per hour (no operator).

(H)    Use of the chipper and operator shall be sixty-five dollars per hour. The chipper shall not be removed from within the city limits of the city of Sumas.

(I)    Use of the Hi-Pot tester shall be thirty dollars per day.

(J)    Use of the flat deck trailer shall be twenty-five dollars per half day and fifty dollars per day.

(2)    Except as otherwise provided above or specifically authorized in writing by the city, the equipment listed above shall remain within ten miles of the city limits of the city of Sumas.

(3)    Except as otherwise provided above or specifically agreed upon in writing by the city, there shall be a minimum charge of one hour for use of city-owned equipment.

(4)    The utility superintendent for the city shall administer the provisions of this section. Nothing contained in this section shall require the city to allow the use of its equipment. The city may require the posting of satisfactory security deposits and the execution of appropriate use agreements as a prerequisite to utilizing city-owned equipment.
