LOADING AND UNLOADING EXPLOSIVES

8.42.010 Definitions.
The definition of terms as contained in the WSEA shall apply in all respects to the terms and conditions as contained in this chapter. Specifically, the term “explosive” as used herein, shall be as defined in the Washing ton State Explosives Act (RCW 70.74.010), and shall include within said definition Class A, B and C explosives. 8.42.020 Adoption of state explosives act.
The city adopts the Washington State Explosives Act (WSEA) as encompassed in RCW 70.74.010 through 70.74.350, inclusive, together with all amendments as may hereinafter be enacted. (Ord. 894 § 1, 1984)
8.42.030 Loading and unloading requirements.
It is unlawful for any person to load and/or unload explosives within the city limits. It is unlawful for any person to authorize, order or condone the loading and/or unloading of explosives within the city limits. (Ord. 894 § 2, 1984)
8.42.040 Violation-penalty.
Any person who fails to comply with or who violates any of the provisions of this chapter, including violations of the WSEA, shall be guilty of a gross misdemeanor, and upon conviction shall be punished by a fine of not less than one hundred dollars nor more than one thousand dollars.
