COMMERCIAL TRUCK PARKING RESTRICTIONS

9.54.010 Weight restrictions in residentially zoned areas.
It shall be unlawful to park commercial motor trucks or truck tractors or tractor trailers of sixteen thousand pounds gross weight or more on public property or streets, within residentially zoned areas in the city. (Ord. 1011 § 1, 1990)
9.54.015 Parking restrictions.
1. It shall be unlawful to park commercial trucks (including trucks weighing ten thousand pounds gross weight or more, tractors, trailers, or any combination thereof) on public property or streets in violation of the following provisions:
(a) Commercial trucks may park on the east side of Sumas Avenue north of Harrison Street for a period of time not to exceed thirty minutes within a twenty-four-hour period;
(b) Commercial trucks are prohibited from parking in the 100 block of East Garfield Street, except that active loading and unloading is allowed on the south side of the 100 block of East Garfield Street between Cherry Street and 121 East Garfield Street for a period of time not to exceed thirty minutes within a twenty-four-hour period;
(c) Commercial trucks are prohibited from parking in the 100 block of West Garfield Street on the south side of the street;
(d) Commercial trucks may park in the 100 block of West Garfield Street on the north side of the street for a period of time not to exceed two hours within a twenty-four-hour period;
(e) Commercial trucks may park on the west side of Railroad Street between 1st Street and 3rd Street for a period of time not to exceed two hours within a twenty-four-hour period;
(f) Commercial trucks are prohibited from parking on the east side of Railroad Street between 1st Street and 3rd Street;
(g) Commercial trucks are prohibited from parking on Railroad Street between Garfield Street and 1st Street; and
(h) Commercial trucks are prohibited from parking in the 100 block of West Cleveland Street.
For purposes of this section, a “commercial truck” shall include all commercial motor trucks, truck tractors, trailers, tractor-trailers, or any combination thereof, including trucks weighing ten thousand pounds gross weight or more.
2. It shall be unlawful to drop or park any commercial truck trailer on public property or streets unless the trailer is attached to a tractor by which it may be propelled or drawn. (Ord. 1504 § 1, 2008: Ord. 1471 § 1, 2007: Ord. 1440 § 1, 2006: Ord. 1325 § 1, 2001)
9.54.021 Violation—Penalty.
Violation of any of the provisions of this chapter is a traffic offense, whether or not the act at issue occurred upon a roadway, and shall be punished as follows:
(a) First Offense. The first offense shall be punished by a penalty of not more than two hundred fifty dollars, including all costs and assessments, and not less than twenty-five dollars, which minimum amount shall not be suspended or deferred.
(b) Second Offense. The second offense within a five-year period shall be punished by a penalty of not more than two hundred fifty dollars, including all costs and assessments, and not less than seventy-five dollars, which minimum amount shall not be suspended or deferred.
(c) Third or Subsequent Offense. A person committing a third or subsequent offense within a five-year period shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine not to exceed one thousand dollars or imprisonment in jail not to exceed ninety days or by both such fine and imprisonment. The minimum sentence shall be one hundred dollars, which amount shall not be suspended or deferred.
Law enforcement officers commissioned by the city are authorized to issue a notice of infraction upon certification that the officer has probable cause to believe, and does believe, that a person has committed an infraction contrary to the provisions of this chapter. The infraction need not have been committed in the issuing office’s presence except as otherwise provided by law. (Ord. 1328 § 1, 2001)
