11.12.010 Notice of street vacations to utilities required.

In addition to the notice requirements for vacations as required by RCW 35.79.020 as adopted by RCW 35A.58.020, all Sumas utilities and Sumas utility franchisees serving the city of Sumas (other than the city itself) shall be given written notice by mail, as required by RCW 35.79.020 as it now exists or as it may hereafter be amended, and said notice shall be required regardless of whether the vacation is initiated by petition of the property owners or by resolution of the city council. 11.12.020 Fees and associated costs.

A petition for vacation of any street or alley initiated by the owners of abutting property pursuant to Chapter 35.79 RCW shall be accompanied by an application fee in an amount established by the city council. Petitioner(s) shall also be liable to the city for all actual expenses incurred in processing the petition in excess of normal costs intended to be covered by the petition/application fee, including legal, surveying, engineering, and appraisal fees. 11.12.030 Vacation petition application.

In addition to any other requirements, any petition for vacation shall require the completion of a written application on a form acceptable to the city, and shall include at least the following information:

(a)    A description of the street or alley sought to be vacated;

(b)    A legal description of the property of petitioner(s) abutting upon the street or alley sought to be vacated; and

(c)    Proof of ownership and tax statement. (Ord. 1571 § 3, 2011)
