2.114.010 Authority.

Chapter 1.80 RCW, the Uniform Electronic Transactions Act, authorizes the city to utilize electronic signatures and electronic documents in the course of governmental transactions. (Ord. 2817 § 1 (Exh. A), 2022; Ord. 2717 § 1 (Exh. A) (part), 2019)

2.114.020 Public interest.

The city council of the city of Sumner finds it to be in the public interest to allow the use of electronic records and electronic signatures for city business to the fullest extent allowed by law. (Ord. 2817 § 1 (Exh. A), 2022; Ord. 2717 § 1 (Exh. A) (part), 2019)

2.114.030 Signatures.

A. The mayor, mayor pro tempore and their authorized representatives, shall have authorization to use an electronic signature platform or alternative of such platform to affix electronic signatures to electronic records, including but not limited to ordinances, resolutions, contracts, applications, publications, and all other electronic documents through which the city conducts business.

B. The city administrator, city department directors, and all authorized representatives or designees thereunder, shall have authorization to use the electronic signature platform or any future replacement or alternative of such platform to affix electronic signatures to electronic records, including but not limited to ordinances, resolutions, contracts, applications, publications, and all other electronic documents through which the city conducts business.

C. The city may accept the submission of, and signature upon, any document electronically so long as the city has reasonable assurance that the means and methods used in electronically signing or submitting the document ensure the integrity, authenticity and nonrepudiation of the signature or document received. 2.114.040 Original signature required, when.

A city document that is required by law to be signed by an original, nonelectronic, “wet” signature may not be digitally or electronically signed. (Ord. 2817 § 1 (Exh. A), 2022; Ord. 2717 § 1 (Exh. A) (part), 2019)

2.114.050 Effect.

An electronic signature on a record (as those terms are defined in RCW 1.80.060) shall be given the same force and effect as the use of a signature affixed by hand. An electronically accepted, submitted, or signed document shall be deemed the equivalent of an original signed document if the individual or entity signing the document has complied with the provisions of this chapter.
