17.90.010 Purpose.

The purpose of this chapter is to provide definitions of marijuana, marijuana infused products, marijuana businesses and medical marijuana cooperatives and to establish that marijuana businesses and medical marijuana cooperatives are not permitted in any zone in the city of Toppenish. 17.90.020 Definitions.

For the purposes of this chapter, the following words and phrases shall have the following meanings:

A. “Marijuana” means all parts of the plant cannabis, whether growing or not, with a THC concentration greater than 0.3 percent on a dry weight basis; the seeds thereof; the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds, or resin. The term does not include the mature stalks of the plant, fiber produced from the stalks, oil or cake made from the seeds of the plant, any other compound, manufacture, salt, derivative, mixture or preparation of the mature stalks (except the resin extracted therefrom), fiber, oil, or cake, or the sterilized seed of the plant which is incapable of germination.

B. “Marijuana business” means a marijuana retail outlet, medical marijuana retail outlet, marijuana production by a marijuana producer or marijuana processing by a marijuana processor as defined herein.

C. “Medical marijuana cooperative” means a cooperative licensed by the State of Washington Liquor and Cannabis Board consisting of qualifying medical marijuana patients or designated medical marijuana providers in order to share responsibility for acquiring and supplying the resources needed to produce and process marijuana only for the medical use of members of the cooperative.

D. “Marijuana-infused products” means products that contain marijuana or marijuana extracts and are intended for human use. The term “marijuana-infused products” does not include usable marijuana.

E. “Marijuana processor” means a person licensed by the State of Washington Liquor and Cannabis Board to process marijuana into usable marijuana and marijuana-infused products, package and label usable marijuana and marijuana-infused products for sale in retail outlets, and sell usable marijuana and marijuana-infused products at wholesale to marijuana retailers.

F. “Marijuana producer” means a person licensed by the State of Washington Liquor and Cannabis Board to produce and sell marijuana at wholesale to marijuana processors and other marijuana producers.

G. “Marijuana retailer” means a person licensed by the State of Washington Liquor and Cannabis Board to sell usable marijuana and marijuana-infused products in a retail outlet.

H. “Marijuana retail outlet” means a location licensed by the State of Washington Liquor and Cannabis Board for the retail sale of usable marijuana and marijuana-infused products.

I. “Medical marijuana retailer” means a person licensed by the State of Washington Liquor and Cannabis Board to sell usable marijuana and marijuana-infused products to qualified medical marijuana patients in a retail outlet.

J. “Medical marijuana retail outlet” means a location licensed by the State of Washington Liquor and Cannabis Board for the retail sale of usable marijuana and marijuana-infused products to qualified medical marijuana patients. (Ord. 2016-15 § 2, 2016).

17.90.030 Marijuana businesses and medical marijuana cooperatives prohibited.

Marijuana businesses and medical marijuana cooperatives are prohibited and not allowed in any zone within the city. (Ord. 2016-15 § 2, 2016).
