5.20.010 Definitions.

A “trade stimulator” within the meaning of this chapter shall be a board or device containing a number of slips of paper or other substance which may be punched or drawn from such receptacle by any person desiring so to do, said device or board being commonly known as a “punch board” or “pull board,” and which the public, upon payment of a consideration, may punch or draw such paper or other substance from such receptacle and may obtain an award. 5.20.020 License fee – Additional fee.

Each and every person, firm or corporation owning or operating or exposing for the use of the public within the town of Twisp any device commonly known as a “trade stimulator” shall pay an annual license fee of $10.00, plus an additional fee equal to 50 percent of the license fee provided for the particular business under the provisions of applicable license fees or occupation taxes. The license year shall be the calendar year, and the amount of the license for less than a year shall be as set by resolution of the town council. The license and license fee required by this chapter are separate from and in addition to the business license issued under Chapter 5.25 TMC, which may also be required when applicable. 5.20.030 Operation and display – Seizure of unlawful devices.

It shall be the duty of the city marshal and the deputy city marshals to the town of Twisp, as well as of the treasurer, to examine from time to time all “trade stimulation” devices found or displayed within the town of Twisp, to determine whether such devices are being operated and displayed by a person duly licensed hereunder and through the Washington State Gambling Commission so to do, and whether such devices have affixed thereto the necessary and proper amount of stamps as required by this chapter. In addition to any other penalties herein provided, the proper officers of the town of Twisp shall, if any such devices are found to be unlicensed or if an insufficient amount of stamp taxes be affixed thereto, seize such devices and all merchandise thereon or used in connection therewith. All sums of money received by the town of Twisp from the sale or disposal of such devices, or the merchandise seized and confiscated in connection therewith shall be paid into the general fund of the town of Twisp. 5.20.040 Violation – Penalty.

Any person or persons failing to comply with any of the terms of this chapter, or violating any of the terms thereof, shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not to exceed $100.00 or by imprisonment in the city jail for a term of not exceeding 30 days, or by both such fine and imprisonment.
