2.01.010 Public records.

Maintenance and access to the city’s public records shall be as provided for in RCW Chapter 42.17. (Ord. 94-12 § 1(Exh. A)(part), 1994).

2.01.020 Designation of agents for receiving claims and accepting service of process.

A. Chapter 4.96 RCW is hereby adopted as the procedure for bringing a claim for damages against the city of Walla Walla.

B. Any claim which may be brought pursuant to the provisions of Chapter 4.96 RCW must be timely filed with the deputy city manager of the city of Walla Walla or the administrative assistant to the deputy city manager of the city of Walla Walla, at Walla Walla City Hall at 15 N. Third Avenue, Walla Walla, Washington, during normal business hours designated by Section 2.45.010; provided, however, that filing of a claim pursuant to this subsection shall not substitute for or excuse service of process on the city of Walla Walla.

C. Any summons against the city of Walla Walla must be personally served upon the mayor or city manager of the city of Walla Walla, or, during normal business hours designated by Section 2.45.010, upon the city clerk or the executive assistant to the city manager of the city of Walla Walla; provided, however, that service of process pursuant to this subsection shall not substitute for or excuse presenting and filing of a claim pursuant to Chapter 4.96 RCW as a prerequisite to commencement of an action against the city of Walla Walla. 2.01.030 City attorney – Duties.

The city attorney shall represent the city in all actions brought by or against the city or against city officials in their official capacity, supervise and prosecute all criminal and civil actions in which the city may be a party and all actions for the recovery of debts, fines, penalties, and forfeitures accruing to the city, advise city authorities and officers in all legal matters pertaining to the business of the city, approve all ordinances to form, and perform such other duties as the city council by ordinance may direct. 2.01.040 Order of application of payments on city utility accounts.

Whenever a payment is made upon a city of Walla Walla utility account, the payment shall be applied in the following order to the amounts owed: first to penalties, second to accrued interest, third to recycling fees and charges, fourth to sanitation (garbage collection) fees and charges, fifth to water service fees and charges, sixth to stormwater fees and charges, and seventh to wastewater (sewer service) fees and charges.
