9.38.010 Purpose.

The provisions established herein are intended to promote the welfare of the mayor, city council members and the city of Wapato by making intimidation of elected city officials unlawful and to encourage citizens to report acts of intimidation to the Wapato police department.  (Ord. 1132(part), 2005)

9.38.020 Definitions.

A.  “Intimidation” means any or all of the following:

1.  Harassing, tormenting or threatening the mayor or city council members with any lewd, vulgar, offensive, profane, indecent, or obscene words or language, or suggesting the commission of any lewd or offensive act; or

2.  Harassing, tormenting or threatening the mayor or city council members with the threat to inflict injury on the person or property of the person harassed, tormented, threatened or embarrassed or any member of his or her family or household; or

3.  Damaging personal property with the intent to harass, torment or threaten the mayor or city council members or any member of his or her family or household; or

4.  Assaulting the mayor or city council members with the intent to harass, torment, threaten or embarrass that person or any member of his or her family or household.

B.  “Fund” means the reward fund established by the city of Wapato pursuant to Wapato Municipal Code Section 9.38.040.  (Ord. 1132(part), 2005)

9.38.030 Intimidation--Penalties.

Intimidation, as defined in Section 9.38.020, shall be a misdemeanor.  Notwithstanding the misdemeanor classification called for herein, should state law provide for a higher grade offense for multiple violations of the acts prohibited by this section, or otherwise, said state law shall prevail.  The minimum penalty for intimidation against the mayor or city council members shall be a fine of five hundred dollars and forty-eight consecutive hours in jail.  The maximum penalty shall be a fine of one thousand dollars and ninety days in jail.  (Ord. 1132(part), 2005)

9.38.040 Reward fund.

A reward fund shall be created and funded by the Wapato city council to reward citizens who give the Wapato police department any relevant information that leads to the apprehension and conviction of any person or persons carrying out the crimes listed in this chapter.  The amount of the fund awarded for such information in each case may be up to one thousand dollars at the discretion of the Wapato city council.  The Wapato city council may ask for input from the Wapato police chief to determine the amount of the award in each case.  If the Wapato police chief recommends an award greater than one thousand dollars, the Wapato city council may follow that recommendation.  No funds shall be paid out until after the arrest and conviction of any person or persons carrying out the crimes listed in this chapter.  The total reward money for any calendar year may not exceed five thousand dollars.  (Ord. 1132(part), 2005)
