10.08.010 Definitions.

For the purpose of this section, the following terms, phrases, words and their derivation shall have the meaning given in this section.  When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number and words in the singular number include the plural number.

"City" means the city of Wapato, Washington.

"Person" means any person, firm, partnership, association, corporation, company or organization of any kind.

"Shall" is always mandatory and not merely directory.

"Truck" means any vehicle designed or operated for the transportation of property, and whose body weight or whose combined body and load weight exceeds ten thousand pounds.

"Truck route" means a way over certain streets, as designated in this section, over and along which trucks coming into and going out of the city must operate.  (Ord. 812 §1, 1983)

10.08.020 Applicability--Exceptions.

A.  All trucks within the city shall be operated only over and along the truck routes established by this chapter.

B.  Exception.  This chapter shall not prohibit:

1.  Operation on Street of Destination.  The operation of trucks upon any street where necessary to the conduct of business at a destination point, provided streets upon which such traffic is permitted are used until reaching the intersection nearest the destination;

2.  Emergency Vehicles.  The operation of emergency vehicles upon any street in the city;

3.  Public Utilities.  The operation of owned or operated by the city, public utilities, any contractor or material man, while engaged in the repair, maintenance or construction of streets, street improvements or street utilities within the city;

4.  Detoured Trucks.  The operation of trucks upon any officially established detour in any case where such truck could lawfully be operated upon the street for which such detour is established.  (Ord. 812 §2, 1983)

10.08.030 Truck routes established.

Truck routes are established as follows:

A.  Donald Road, from the north city limits to West First Street;

B.  North Camas, from Donald Road to city limits;

C.  Wapenish Road (Track Road), from east city limits to west city limits;

D.  Sitcum Avenue;

E.  Satus Avenue, from Sitcum Avenue to West Second Street;

F.  Wasco Avenue, from Sitcum Avenue to West Second Street;

G.  Yakima Avenue, from West First Street to West Second Street;

H.  West First Street, from west city limits to Trader Street;

I.  Trader Street, from Wapato Avenue to East Third Street;

J.  South Camas, from Third Street to south city limits;

K.  West Second Street from South Yakima Avenue to South Satus Avenue;

L.  North Ahtanum Avenue;

M.  U.S. Highway 97;

N.  Hoffer Road.  (Ord. 1238 §1D, 2011:  Ord. 812 §3, 1983)

10.08.040 Temporary parking for loading or unloading.

Trucks and/or trailers may be temporarily parked on streets not designated as truck routes only for the expeditious loading and unloading of materials, and shall not be parked in such a way as to constitute a traffic hazard.  No trucks and/or trailers shall be allowed to temporarily park for loading, unloading or any other reason on South Wapato Avenue or West First Street at any time.  This section does not apply to garbage trucks operating in the normal course of business.  (Ord. 1238 §1E, 2011:  Ord. 812 §4, 1983)

10.08.050 Enforcement.

A.  Fire Chief Maintains Maps.  The fire chief shall keep and maintain accurate maps setting up truck routes and streets upon which truck traffic is permitted.  The maps shall be kept on file at the fire station and shall be available to the public.

B.  Weigh-in.  The chief of police shall have the authority to require any person driving or in control of any commercial vehicle or truck not proceeding over a truck route or street over which truck traffic is permitted to proceed to any public or private scale available for the purpose of weighing and determining whether this chapter has been complied with.  (Ord. 1238 §1F, 2011:  Ord. 812 §5, 1983)

10.08.060 Violation--Penalty.

Any person, firm or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in an amount not exceeding one thousand dollars, or serve a maximum of ninety days in jail, or both.  (Ord. 1238 §1G, 2011:  Ord. 812 §6, 1983)
