19.03.010 Class review classification.

Three classes of review are established for the purposes of this title.  These three classes, their appropriate decision-maker, and the types of permits for each class are contained within Table 1.

19.03.020 Procedures for Class 1 review--Administratively exempt.

Class 1 permit applications require administrative approval but do not require a public hearing or environmental review.  All completed Class 1 applications shall be processed as follows:

A.  If the administrator decides that additional information is required to properly evaluate the application they shall follow the guidelines in WMC 19.04.060.

B.  The administrative official shall review the application with the consistency of appropriate development regulations, as described in 19.060.010 of this title.

C.  The administrative official shall approve or disapprove within twenty-eight days the completed application.  Nothing limits the administrator from attaching conditions for the permit that are found in the comprehensive plan or existing development regulations.  (Ord. 1063 §2(part), 1999)

19.03.030 Procedures for Class 2 review--Planning commission.

Class 2 permit applications are those requiring a final decision from the planning commission and may require a public hearing and/or environmental review.  Following the application process, and issuance of a letter of completeness pursuant to 19.04.040 of this title, the review procedure is as follows:

A.  Notice of application issued pursuant to 19.05.010 of this title;

B.  If required, SEPA threshold determination issued pursuant to 19.06.050 of this title;

C.  If required, a public hearing before the planning commission pursuant to 19.05.030 of this title;

D.  Provide a determination of consistency pursuant to 19.06.010;

E.  Notice of decision issued to applicant pursuant to 19.07.010 of this title.  (Ord. 1063 §2(part), 1999)

19.03.040 Procedures for Class 3 review--City council.

Class 3 permit applications are those requiring a final decision from the city council preceded by a public hearing and may require environmental review.  Following the application process and issuance of a letter of completeness pursuant to 19.04.040 of this title, the review procedure is as follows:

A.  Notice of application issued pursuant to Section 19.05.010 of this title;

B.  If required, a SEPA threshold determination shall be issued pursuant to Section 19.06.050 of this title;

C.  A public hearing issued pursuant to Section 19.05.030 of this title.  Except as otherwise required by law the public hearing on a Class 3 Review shall be before the planning commission;

D.  A staff report containing all matters gathered on the application, which may include a staff recommendation based on known information, shall be distributed to the appropriate hearing body prior to the public hearing;

E.  If the planning commission is the hearing body it shall make a formal recommendation to the city council that includes a determination of consistency pursuant to 19.06.010.  The Planning Commission recommendation and all information regarding the application shall be forwarded to the City Council for a final decision within ten (10) days of making the recommendation.  If the city council is the hearing body, following the public hearing the council shall make a final decision pursuant to Section 19.07.010 of this title unless the application is determined to require additional information and continued review.  (Ord. 1063 §2 (part), 1999)
