19.05.010 Notice of application.

A. The city shall issue a notice of application on all Class 2 and Class 3 project permit applications within fourteen days of the determination of completeness.

B. The notice of application shall be mailed to the applicant’s designated contact person, and, the owners of property within three hundred feet of the project site, according to the records of the Yakima County assessor.

C. The notice shall also be sent to agencies with jurisdiction in the application, as determined by the administrator, and to other persons or entities who request such notice.

D. The administrator may choose to integrate the notice of application and the determination of completeness into one document if the other timing requirements of this title can be met. (Ord. 1063 §2(part), 1999)

19.05.020 Contents of notice of application.

For all Class 2 and Class 3 project permit applications, the administrator shall provide a notice of application that complies with the notice requirements specified in 19.05.010 of this title and shall include:

A. The date of the application, the date of the notice of completion for the application, the date the notice of application is issued;

B. A description of the proposed project action and a list of the project permits included in the application and, if applicable, a list of any studies requested under RCW 36.70B.070 or RCW 36.70B.090;

C. The identification of other permits not included in the application, to the extent known by the city;

D. The identification of existing environmental documents that evaluate the proposed project, and, if not otherwise stated on the document providing notice of application, the location where the application and any studies can be reviewed;

E. The date when the public comment period ends, which shall be no less then fourteen days and no more then thirty days following the date of the notice of application, and a statement of the right of any person to comment on the application and become a party of record for the application;

F. The date, time, place and type of hearing, if applicable and scheduled at the date of notice of the application;

G. A statement of preliminary determination of consistency as provided in Section 19.06.010, if one has been made at the time of issuance of the notice of application, and of those development regulations that will be used for project mitigation.

H. Any other information determined appropriate by the administrator. (Ord. 1063 §2(part), 1999)

19.05.030 Notice of public hearing.

A. For permit applications which require a public hearing the notice of public application may include the notice of public hearing.

B. For project permit applications that require a public hearing a public notice shall be published in the general newspaper of record at least fourteen days prior to the public hearing and coincide with the public comment period with the notice of application in Section 19.05.010.

C. Content of Notice of Public Hearing. The notice given of an open record public hearing required in this chapter shall contain:

1. The project location;

2. A brief description of the subject property reasonably sufficient to inform the public of its location, which may be in the form of either a vicinity location, written legal description, or other address/graphical description;

3. The date, time, and place of the hearing;

4. The permits being applied for or being required;

5. The nature of the proposed use or development;

6. A statement that all interested persons may appear and provide testimony;

7. Location where the application and file may be examined and when and how written comments addressing findings required for a decision by the hearing body may be submitted, including the name of a city staff to contact and a telephone number where additional information may be obtained. 19.05.040 Limitations on open public record hearings and closed record appeals.

Except for the appeal of a SEPA determination of significance, no more than one open public record hearing and no more than one closed record appeal may occur on a single project permit application or master application. (Ord. 1063 §2(part), 1999)

19.05.050 Public comment on the notice of application.

All public comments on the notice of application must allow no less than fourteen days and no more than thirty days for public comment from the date the application is mailed out, and if required published in the newspaper of record. If the fourteenth day ends on a weekend or holiday, it shall be automatically extended to the end of the next business day. Comments may be mailed, personally delivered or sent by facsimile. Comments should be as specific as possible regarding the project application. (Ord. 1063 §2(part), 1999)
