3.28.010 Payment procedure.

All warrants upon any and every fund of the town, including all special funds, are payable on demand unless otherwise provided in said warrants or by the ordinance or order authorizing their issuance, and shall be presented to the town clerk/treasurer for payment, who shall pay the same if there is sufficient available money in the fund upon which the warrant presented is drawn, and write on the face of any such warrant the date of payment and his signature. All warrants shall be paid in the order of their issuance, and no warrant shall be paid from any fund unless there remains after such payment money in the fund sufficient to pay all outstanding warrants issued prior to the warrant so presented for payment. If there is no available money in the proper fund to pay any warrant when presented, he shall endorse thereon, “Not paid for want of funds,” and the date of such endorsement over his signature, which shall entitle said warrant thenceforth to draw legal interest, unless some different interest rate is legally provided for by said warrant or by ordinance or order authorizing its issuance; and such warrants shall be called “registered warrants.” (Ord. 102 § 1, 1914).

3.28.020 Call for registered warrants authorized when.

When any money shall be available in any fund of the town, inclusive of special funds, and there shall be registered warrants on said fund outstanding, or warrants which under their terms or the terms of the ordinance or order authorizing their issuance, are payable on call by the town, the council of the town may order a call for presentation and payment of any such warrants as the available money in the fund upon which they are drawn will pay in full. Said call shall be made by the publication for two consecutive issues in some newspaper of general circulation printed and published in the town of a notice stating that there is sufficient money to pay such warrants, stating the warrant numbers, the fund upon which drawn and the date upon which payment will be made; and from and after the date so named, any warrant so called shall cease to bear interest.
