10.22.010 Definitions.

An “engine compression brake device” is any device that uses the engine and transmission to impede the forward motion of the motor vehicle by compression of the engine. (Ord. 676 § 1, 2006).

10.22.020 Compression braking prohibited.

No person shall use an engine compression brake device within the corporate limits of the town of Waterville; provided, that the use of an engine compression brake device in order to protect persons and/or property shall be an affirmative defense to a violation of this section. The town superintendent is authorized and directed to post permanent traffic signs advising the public of the prohibition of compression braking. (Ord. 676 § 1, 2006).

10.22.030 Violation – Penalty.

A violation of this chapter shall constitute an infraction punishable by a civil penalty not to exceed $75.00 for a first violation, $150.00 for a second violation, or $250.00 for a third or subsequent violation. (Ord. 676 § 1, 2006).
