10.36.010 Definitions.

“Wheeled all-terrain vehicle” (“ATV”) means:

A. Any motorized nonhighway vehicle with handle bars that are 50 inches or less in width, has a seat height of at least 20 inches, weighs less than 1,500 pounds, and has four tires having a diameter of 30 inches or less; or

B. A utility type vehicle designed for and capable of travel over designated roads that travels on four or more low pressure tires of 20 psi or less, has a maximum width less than 74 inches, has a maximum weight less than 2,000 pounds, has a wheelbase of 110 inches or less, and satisfies at least one of the following:

1. Has a minimum width of 50 inches;

2. Has a minimum weight of at least 900 pounds; or

3. Has a wheelbase of over 61 inches. (Ord. 746 § 1, 2014).

10.36.020 Use for public good.

The use of ATVs shall be permitted on city sidewalks for plowing snow or other approved operations as designated by the town council. (Ord. 746 § 1, 2014).

10.36.030 Operation of ATVs.

The operation of ATVs on public roads, including State Route 2, within the town of Waterville is allowed subject to all requirements of Chapter 46.09 RCW as it now exists or as it may hereafter be amended. Chapter 46.09 RCW is hereby adopted and made a part hereof by this reference. (Ord. 746 § 1, 2014).

10.36.040 Violation – Penalty.

Violation of this chapter shall be an infraction, and any person found to have committed such an infraction shall be assessed a monetary base penalty consistent with the Infraction Rules for Courts of Limited Jurisdiction, together with all statutory assessments, as they now exist or as they hereafter may be amended.
