5.30.010 Definitions.

“Flight school” means the business or occupation of giving aeronautical, mechanical or flight instruction in the maintenance and/or operation of airplanes on any municipal airport owned or operated by the city of Wenatchee, including the Pangborn Field Municipal Airport.

“Operator” means and includes every person, firm, association or corporation who engages in the business or occupation of operating a flight school or giving aeronautical, mechanical or flight instruction in the maintenance and/or operation of airplanes on any municipal airport owned or operated by the city of Wenatchee, including the Pangborn Field Municipal Airport. Airplane demonstrations and check-outs are exempt from this chapter.

“Place of business” means a designated office location in a permanent building on the Municipal Airport at which said operator conducts said flight school, in which said offices shall be continuously installed and maintained a business telephone in the name of the operator and at which office the business of said flight school is transacted and its records kept. 5.30.020 License required – Fee – Renewal.

No operator shall engage in the business of conducting a flight school without being the holder of a license for such purpose issued by the city clerk of the city of Wenatchee. An application for license under this chapter shall be filed with the city clerk and shall contain such information as required in this chapter and as the city clerk or the city of Wenatchee may require hereafter. Every such application shall be accompanied by an application fee of $5.00 which shall in no event be refunded. If an application is approved by the city commission of the city of Wenatchee, the applicant, upon payment of an additional fee of $10.00, shall be granted a license which shall be valid for the calendar year in which said license is issued. The annual fee for the renewal thereof shall be $10.00 for the calendar year or any part thereof. The city clerk shall, each calendar year issue a license certificate to each licensee, which certificate shall be conspicuously displayed in the place of business of the licensee. 5.30.030 Transfer of license prohibited.

Flight school licenses shall not be transferable. In the event of any transfer of ownership in the business, an application for a new license must be obtained in accordance with this chapter. (Ord. 1677 § 3, 1961)

5.30.040 License application – Temporary license.

Each applicant shall state his name, age, place of birth, place of residence, employment and occupation for the past five years, length of time he has been a licensed pilot, marital status, length of time he has resided in the city, length of time he has been a licensed instructor, whether or not any aeronautical license has been previously suspended or revoked and, if so, for what cause, whether or not he has ever been convicted of a crime and, if so, the number of convictions, the approximate dates thereof, the name of the courts, the crimes with which charged, and the final disposition thereof, and a detailed financial statement.

The city of Wenatchee may deny the application of any applicant if the city of Wenatchee determines that said applicant has made a material false statement or concealed a material fact in connection with his application or fails to qualify under any of the other conditions set forth in this chapter.

The city of Wenatchee may in its discretion issue a temporary flight school license to any applicant pending the completion of processing of said applicant’s application, which said temporary flight school license shall be revocable at any time without notice. (Ord. 1677 § 4, 1961)

5.30.050 Liability insurance.

Each applicant must, prior to issuance of a license hereunder, deposit with the city clerk a policy of insurance, together with evidence of premium payment, issued by a responsible insurance company approved by the city of Wenatchee, providing indemnity for or protection of persons and property in the care, custody and control of licensee and of third parties, against loss, as follows:

(1) A legal liability policy covering the operation of licensee’s flight school and equipment for any bodily injury or property damage with minimum coverage of $100,000 for any one person killed or injured in any one accident or occurrence, and $300,000 for more than one person injured or killed in any one accident or occurrence. Such policy shall also provide $25,000 minimum coverage for all damage arising out of injury to or destruction of property.

(2) The policy must contain an endorsement providing for not less than 10 days’ notice to the city of Wenatchee in the event of any material change or cancellation. (Ord. 1677 § 5, 1961)

5.30.060 Additional requirements.

In addition to complying with other provisions of this chapter, each applicant for a flight school license must show that he:

(1) Has a good credit rating;

(2) Is a person of good moral character;

(3) Has complied with all current Federal Aviation Agency regulations, is a licensed and qualified flight instructor, and the aeronautical equipment and airplanes to be used in giving flight instruction meet the standards prescribed by the Federal Aviation Agency. (Ord. 1677 § 6, 1961)

5.30.070 Revocation.

The city of Wenatchee shall have the power to revoke said license on any of the following grounds:

(1) If said license was procured by fraudulent conduct or false statement of a material fact, or if a fact concerning an applicant was not disclosed at the time of his making application when such fact would have constituted cause for refusal to issue said license.

(2) If the licensee violates any of the provisions of this chapter or any rule or regulation promulgated by the Federal Aviation Agency, the city of Wenatchee, or any other rule or regulation by any competent authority pertaining to the use of, and any activity on, said municipal airport of the city of Wenatchee.

(3) If the licensee fails to keep in full force and effect the policies of insurance herein required.

(4) If the licensee fails to keep and maintain engine and aircraft log books and/or fails to make the same available to any authorized personnel of the city of Wenatchee for inspection on request.

Such revocations shall forthwith terminate all authority and permission heretofore granted under said license by the city of Wenatchee to the licensee. (Ord. 1677 § 7, 1961)

5.30.080 Severability.

The provisions of this chapter are declared to be severable, and if any section, sentence, clause or phrase shall for any reason be held to be invalid or unconstitutional, such declaration shall not affect the validity of the remaining sections, sentences, clauses or phrases of said chapter but the same shall remain in effect, it being the legislative intent that the remainder of this chapter shall stand, notwithstanding the invalidity of any part thereof. 5.30.090 Penalty for violations.

It shall be unlawful for any person to be an operator of a flight school contrary to the provisions of this chapter, and it shall be unlawful for any person to violate any of the provisions of this chapter or to counsel, aid, abet, assist or encourage a violation thereof, and any person so violating or failing to comply with the provisions of this chapter, or counseling, aiding, abetting, assisting or encouraging a violation shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine in any sum not to exceed $100.00 or by imprisonment in the city jail for a period not to exceed 30 days, or by both such fine and imprisonment.
