17.81.010 Interpretation and application of this title.

In interpreting and applying the provisions of this title, such provisions shall be held to be the minimum requirements for the promotion of the public health, safety, and general welfare; therefore, when these chapters impose a greater restriction upon the use of buildings or premises, or require larger open spaces than are imposed or required by other laws, resolutions, rules or regulations, the provisions of this title shall control. 17.81.020 Violation – Complaint filing – Appeal procedure.

Whenever a violation of this title occurs, or is alleged to have occurred, any person may file a written complaint. Such complaint, stating fully the causes and basis thereto, shall be filed with the administrator, who shall record properly such complaint, investigate, and take action thereon as provided by this title. 17.81.030 Enforcement – Conformance required.

It shall be the duty of the administrator or duly authorized administrative official to enforce this title through proper legal channels. The building official shall not authorize the issuance of any permit for construction, alteration, or repair of any building or part thereof unless such plans and intended use of such buildings or land conform in all respects with the provisions of this title. 17.81.040 Violations – Penalties.

A. Any person convicted of a violation of any provision of this title shall be punished by a fine of not more than $5,300 or by imprisonment for not more than one year, or by both such fine and imprisonment.

For any violation of a continuing nature, each day’s violation shall be considered a separate offense and subject the offender to the above penalties for each offense.

B. In addition to the enforcement provisions of this section, any violation of any of the provisions of WRMC 17.54.450 is declared to be a public nuisance, per se, which shall be abated by the city attorney by way of civil abatement procedures. 17.81.050 Severability.

If any section, subsection, sentence, clause, or phrase of any portion of this title is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this title. The city council of the city of West Richland hereby declares that it would have adopted this title and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional.
