8.08.010 Unlawful to keep in offensive manner.

It is unlawful for any person, firm or corporation to keep, use or maintain within the city any pen, lot, place or premises in which any fowls may be confined or kept, in such manner as to be nauseous, foul or offensive, or from any cause to be an annoyance to any community, family or person. 8.08.020 Definitions.

(1) For the purpose of this chapter, “small to medium fowl” is defined as chickens, ducks and other common farm birds weighing up to eight pounds.

(2) For the purpose of this chapter, “large fowl” is defined as geese, turkeys, peacocks, emus, ostriches and other birds weighing over eight pounds. (Ord. 1713, 2025)

8.08.030 Number of fowl allowed in city limits.

It is unlawful for any person, firm or corporation to keep, use or maintain within the city limits any small to medium fowl numbering greater than 12.

It is unlawful for any person, firm or corporation to keep, use or maintain within the city limits any large fowl numbering greater than two. (Ord. 1713, 2025)

8.08.040 Roosters and other loud fowl in city limits.

It is unlawful for any person, firm or corporation to keep, use or maintain within the city limits any roosters or other crowing or screeching fowl. (Ord. 1713, 2025)

8.08.050 Running at large unlawful.

It is unlawful for any person, firm or corporation to permit any fowls owned by him or it to run at large within the city. (Ord. 1713, 2025; Ord. 122 § 2, 1945. Formerly 8.08.020)

8.08.060 Enforcement, violation and penalty.

This chapter may be enforced by any authorized representative of the city including, but not limited to, the chief of police, building official, code enforcement official, city administrator or designee. Any person, firm or corporation who shall violate any of the items in this chapter shall be subject to a monetary penalty as described in WMC 8.12.210.

Nothing in this chapter shall be construed to allow any “grandfather” or “preexisting” status of fowl kept on a residential lot in the city limits. Any person, firm or corporation having previously exceeded the limits of fowl as of the date of the ordinance codified in this chapter shall have 90 days to comply with this chapter and shall not replace any fowl over the listed legal limit.
