8.16.010 Purpose.

The considered opinion of the county council is that self-service stations constitute a serious fire hazard because of the lack of supervision of sales and deliveries of gasoline and other flammable liquids by trained personnel; therefore, as a safety measure, this chapter shall regulate sales and deliveries of flammable liquids. (Ord. 93-048 (part); prior code § 4.36.010).

8.16.020 Flammable liquid defined.

The term “flammable liquid” as used in this chapter, means and includes gasoline, naphtha, benzol, collodion, acetone, alcohol, amyl acetate, toluol, ethyl acetate, methyl, kerosene, amyl alcohol, turpentine, fuel oil and cleaning solvents. (Prior code § 4.36.020).

8.16.030 Unlawful delivery and dispensing.

It is unlawful for the owner or operator of any garage, service station or other dispensary of flammable liquids, selling or disposing of the same to the public, to permit the delivery or dispensing of any inflammable liquid into any container, except by the owner or operator of such garage, service station or other dispensary, or by a regularly authorized employee of such owner or operator; provided, that this provision shall not prevent the operation of self-service gas stations. 8.16.040 Violation – Penalty.

Any person who violates or fails to comply with any provisions of this chapter shall be guilty of a misdemeanor, and, upon conviction thereof, shall be punished by a fine of not more than $100.00, or by imprisonment for not more than 30 days, or by both such fine and imprisonment.
