6.06.010 Definitions.

For the purposes of this chapter:

A.  “Domestic cats” means any cat, excluding wild cats, that any resident of Wilbur claims ownership of and provides facilities at their residence for said cat or cats and purchased a license for.

B.  “Wild cats” means any feline that by nature is wild and not nominally domesticated for the use as a pet.

C.  “Wild domestic cats” means any house or barn cat that no ownership has been determined to exist between cat and person and is living on its own.  (Ord. 396 §24, 2002)

6.06.020 ID fee.

The ID fee shall be in the sum of five dollars for every cat.  Upon payment of the ID fee to the town clerk, the town clerk shall issue an ID tag the party making application therefor.  The ID tag shall expire on the first day of January next succeeding the date of the issuance thereof and the time fixed for the issuing of an ID tag shall commence on the first day of January of each year and no ID tag shall be issued to expire at any other time than the date set forth in this section.  The ID tag fee set forth in this section shall be paid in full for any year or part thereof.  The town clerk shall, together with such ID, furnish a suitable tag which shall be worn by the cat for which such ID tag is issued and shall be fastened to such cat in such manner that it can easily be inspected at all times by town authorities.  Lost tags will be replaced by the town clerk upon payment of an additional fee of two dollars.  The town clerk shall keep a record of the names of all persons to whom such ID tags are issued with the number of each ID tag.  (Ord. 396 §25, 2002)

6.06.030 Cat or cats running at large.

Due to the nature of cats, it would be impracticable to try to control their movements.  However, live traps may be used to catch cats that are creating a nuisance upon private or public property inside the town limits.  Upon catching a cat with a valid town ID tag, the cat is to be immediately set free.  Cats not wearing a valid ID tag are deemed to be wild domestic cats and are to be disposed of as set forth in this chapter.  (Ord. 396 §26, 2002)

6.06.040 Disposal of domestic cats.

Upon catching a domestic cat that appears to be in good health and not a health hazard, the person may remove the cat to a suitable area where the domestic cat may be released.  If the person is unable to remove the domestic cat to a suitable location, the animal control authority or their designee is to be notified to remove the cat to a suitable location, at their earliest opportunity.  Upon catching a domestic cat that has or appears to have health problems, the animal control authority or their designee shall be notified immediately for the removal of the cat and its humane destruction, if it is determined by the animal control authority or their designee to have health problems, as not to infect any other domestic cat or cats.  (Ord. 396 §27, 2002)

6.06.050 Removing lawfully ID tagged cats or concealing identity of cats.

It shall be illegal to try to conceal or to conceal the identity of a domestic cat or to dispose of a validly ID tagged domestic cat.  (Ord. 396 §28, 2002)

6.06.060 Wild cats inside the town limits--Illegal.

It shall be illegal for any person or persons to harbor or conceal any wild cat or cats inside the town limits of Wilbur.  Wild cat or cats may only be brought into the town limits, upon special approval of the town council and the meeting of any conditions they impose.  (Ord. 396 §29, 2002)

6.06.070 Violation--Penalty.

Violation of any provisions of this chapter shall be a civil infraction and shall be subject to a fine at the rate as set forth in Section 1.08.030.  (Ord. 396 §30, 2002)
