6.08.010 Definitions.

As used in this section:

A.  “Birds of prey” means any carnivorous bird of the group chiefly represented by hawks, eagles, vultures and owls.

B.  “Person” means firms, corporations, associations, partnerships, societies and individuals.

C.  “Reptiles” means any animal that crawls or moves on its belly as a snake or on small short legs as a lizard, alligator or crocodile.

D.  “Wild animal” means any animal that normally lives in a state of nature, not tamed or domesticated.  (Ord. 396 §43, 2002)

6.08.020 Wild animals.

It shall be unlawful for any person or persons to keep, maintain or harbor any wild animal inside the town limits without special consent of the Department of Fish and Wildlife and the town council.  Any person found in violation of this section shall have committed a civil infraction and be subject to a fine as set forth in Section 1.08.030.  Each day of violation shall be deemed a separate offense.  Nothing in this section precludes any person from also being charged under the Revised Code of Washington.  (Ord. 396 §44, 2002)

6.08.030 Birds.

A.  Birds of prey are prohibited from being inside the town limits, under the control of any person.  Any birds, such as parakeets, cockatiels or song birds that are kept inside, in a cage are allowed, birds such as guinea hens, peacocks, ostrich and similar birds are not allowed without obtaining a special permit as outlined in Section 6.07.090.

B.  Any person in violation of this section shall have committed a civil infraction and be subject to a fine as set forth in Section 1.08.030.  Each day of violation shall be deemed a separate offense.  (Ord. 396 §45, 2002)

6.08.040 Reptiles.

All venomous and flesh-eating reptiles are prohibited inside the town limits.  Any person who keeps a venomous or flesh-eating reptile inside the town limits shall have committed a civil infraction subject to a fine of five hundred dollars plus state assessments.  Each day the reptile is kept in the town shall be deemed a separate offense.  Any person owning or in control of a reptile shall not allow such reptile off their property without the reptile being in the control of a responsible adult.  Any person who allows a reptile off their property not properly controlled shall have committed a civil infraction subject to a fine as set forth in Section 1.08.030.  Each day of violation shall be deemed a separate offense.  (Ord. 425 §9, 2004:  Ord. 396 §46, 2002)

6.08.050 Enforcement--Violation--Penalty.

It shall be the duty of the police officers and/or animal control officer as designated by the town of Wilbur to enforce this chapter.  Any person violating any section of this chapter shall have committed a civil infraction and shall be subject to a fine at the rate as set forth in Section 1.08.030.  Each day of violation shall be a separate offense.  (Ord. 396 §47, 2002)
