18.12.010 Establishment.

In order to classify, segregate and regulate the use of land, buildings and structures according to the provisions this title, the town is divided into the following land use zones:

18.12.020 Official map.

The ordinance codified in this title shall consist of the text thereof and also as fully as though contained therein, that certain map identified by the approved signatures of the mayor and town clerk on the title page and original map marked and designated as “The Map of the Zoning Ordinance of the Town of Wilbur,” which map is now on file in the office of the town clerk.  The original map bears the same date as the ordinance codified in this title.  The map has been heretofore examined in detail by the town council, after having been approved by the Wilbur planning commission, and is adopted as part of this title.  This title and each and all of its terms is to be read and interpreted in the light of the contents of said map.  If any conflict between the text of this title and map is deemed to arise, the text of this title shall prevail.  (Ord. 108-B §3.02, 1980)

18.12.030 Zone boundary change.

Changes in the boundaries of the zones shall be made by resolution adopting an amended zoning map, and when so adopted such amended map shall become a part of the ordinance codified in this title.  (Ord. 108-B §3.03, 1980)

18.12.040 Interpretation of boundaries.

Where uncertainty exists as to the boundaries of any zone shown upon the zoning map or any part or unity thereof, the following rules shall apply:

A.  Where such boundaries are indicated as approximately following street or alley lines or lot lines, such lines shall be construed to be such boundaries.

B.  In the case of unsubdivided property, and where a zone boundary divides such property, the location of such boundaries, unless the same are indicated by dimensions, shall be determined by use of the scale appearing on such zoning map.

C.  Where a public street or alley is officially vacated or abandoned, the area comprising such vacated street or alley shall acquire the classification of the property to which it reverts.

D.  Where a public street or alley is officially vacated or abandoned, the area comprising such vacated street or alley shall acquire the classification of the property to which it reverts.

E.  Where a lot is equally bisected longitudinally by a zone boundary line, the total lot shall acquire the most restrictive use classification and the highest area requirement of the town zone classifications involved.

F.  Where a lot is bisected by the boundary line between two zones and such boundary line parallels or approximately parallels the street on which the lot fronts, the total area of such bisected lot shall acquire the same zone requirement as the front portion of the lot.  (Ord. 108-B §3.04, 1980)

18.12.050 Unzoned property.

Any property, for any reason, other than the fact that it is a right-of-way of a street, alley, or railroad, is located within an adopted part of the zoning map but is not designated as being zoned in any of the zones established, shall be deemed to be zoned R-10,000.  (Ord. 108-B §3.05, 1980)

18.12.060 Annexed property.

Any property which may, because of annexation or any other reason, become a part of the ordinance codified in this title and map subsequent to its enactment, shall be deemed to be zoned R-10,000.  (Ord. 108-B §3.06, 1980)

18.12.070 Minimum lot area symbol.

In the R zone, where a number follows the indicated zone classification on the zoning map, such number shall indicate which of the minimum lot areas, yards and open spaces required in the zone applies to the properties involved.  (Ord. 108-B §3.07, 1980)
