6.10.010 Definitions.

“Livestock” shall mean horses, donkeys, mules, goats, cows, hogs, poultry and rabbits.

“Person” shall mean firms, corporations, associations, partnerships, societies and individuals.

“Residence” shall mean any building or part of a building used for the purpose of a human habitation or dwelling. [Ord. 98 § 1, 1965].

6.10.020 Livestock in Town restricted.

It shall be unlawful for any person or persons to keep or maintain livestock within the Town limits of the Town of Wilkeson except as hereinafter provided. [Ord. 98 § 2, 1965].

6.10.030 Enclosures.

All livestock shall be kept within an enclosure adequately built and maintained to prevent said livestock from breaking through, out or over or under the same, and providing one (1) acre per one thousand two hundred (1,200) pounds of total weight of all animals. [Ord. 98 § 3, 1965].

6.10.040 Hogs.

Hogs may be kept or maintained within said Town limits, provided they are kept within an enclosure as above described, the outside limits of which shall not be less than five hundred (500) feet from the nearest property line. [Ord. 98 § 5, 1965].

6.10.050 Poultry and rabbits.

Poultry and rabbits may be kept or maintained within Town limits provided they are kept within an enclosure as above described, the outside limits of which shall not be less than twenty-five (25) feet from the nearest property line, a limit of twenty-five (25) adults; more than twenty-five (25), one hundred (100) feet from the nearest property line. 6.10.060 Manure accumulation.

No person or persons shall permit an accumulation of manure or other refuse on real property owned or occupied by such person or persons within said Town limits to remain on such property for a period of longer than one (1) week. [Ord. 98 § 7, 1965].

6.10.070 Each day separate violation.

Each and every day on which a violation of this chapter occurs and continues shall be considered a separate offense. [Ord. 98 § 8, 1965].

6.10.080 Public health.

This chapter shall not be construed to permit the keeping of animals in any place or manner which will endanger public health and safety. [Ord. 98 § 9, 1965].

6.10.090 Violation – Penalty.

Any person violating this chapter shall be deemed guilty of a misdemeanor and punished by a fine of not exceeding one hundred dollars ($100.00) for each separate offense. [Ord. 98 § 10, 1965].
