19.03.010 Definitions.

“Swimming pool” means and includes either outdoor or indoor private pools, portable or permanently constructed, above or below the ground, which are artificially constructed to provide recreational facilities for swimming, bathing, or wading, and which are intended to be used solely by the owner, operator or lessee thereof and his family, and by friends invited to use it without payment of any fee.

“Wading pool” means and includes artificially constructed pools not designated or used for swimming with a maximum area not exceeding one hundred twenty (120) square feet and a maximum water depth not exceeding twelve (12) inches. [UDC Ord. dated 7/21/1998].

19.03.020 Construction permit – Required when.

It is unlawful to establish or construct a swimming pool without first obtaining a permit therefor in the manner hereinafter prescribed. No permit shall be required for a wading pool. [UDC Ord. dated 7/21/1998].

19.03.030 Construction permit – Application requirements.

Application for a permit to construct a swimming pool accompanied by two (2) sets of plans and specifications or proper descriptive brochures shall be presented to the Town Engineer by the owner of the property. Upon obtaining the endorsement from the Town Engineer, the plans and specifications or brochures shall be submitted by the Town Engineer to the local Health District for approval by endorsement of disinfection, filtering and bacteriological standards. 19.03.040 Location.

A. No swimming pool shall be constructed or installed in any front yard as the term front yard is defined in Chapter 15.02 WMC. In the case of a corner lot, as the term corner lot is defined in Chapter 15.02 WMC, no swimming pool shall be constructed or installed nearer to the side street line than the minimum number of feet required for width of the side yard of the street side of such lot. In no event shall any swimming pool be constructed or installed nearer than ten (10) feet to any property line of the property upon which the pool is to be located. No private swimming pool or wading pool shall be constructed or installed on any lot unless a residence building is located upon the lot as permitted in the zoning ordinance.

B. The pool shall be so situated that normal surface water shall drain away from the pool. [UDC Ord. dated 7/21/1998].

19.03.050 Water supply.

There shall be no physical connection between a potable, public, or private water supply system and such pools at a point below the maximum flow line of the pool, or to a recirculating or heating system of a pool, unless such physical connection is so installed and operated that no pool water can be discharged or siphoned into a potable water supply system. 19.03.060 Discharge system.

No pool discharge system will be allowed which discharges the water into a stream or other natural watercourse or into a storm sewer that discharges to a stream or watercourse. Discharge into the sanitary sewer system of the Town shall be permitted only after inspection and approval by the Town Engineer. The design and layout of the discharge system for the swimming pool shall be submitted to the Town Engineer. The discharge system will specify how the pool will be emptied and drained.

In the event that any public street surface becomes disturbed due to installation of the discharge system and must be replaced or repaired, the cost of the street surface replacement or repair shall be borne by the property owner and shall be resurfaced in accordance with Town ordinance and standards. 19.03.070 Disinfection, filtering and bacteriological standards.

All private swimming pools shall be constructed, installed, and maintained so as to provide necessary equipment for chlorination and other disinfection and filtering to comply with approved bacteriological standards as may be promulgated by regulations issued by the local Health District. 19.03.080 Lighting.

No artificial lighting shall be maintained or operated in connection with the pool in such a manner as to be a nuisance to or an annoyance to neighboring properties. [UDC Ord. dated 7/21/1998].

19.03.090 Enforcement.

Every private swimming pool constructed or to be constructed in the Town shall at all times comply with the requirements of all health authorities having jurisdiction in the premises and the provisions of this chapter and shall be enforced by the Public Works Director. Any nuisance or hazard to health which may exist, or develop in or in consequence of, or in connection with any such swimming pool, shall forthwith be abated and removed by the person in possession of such pool upon receipt of notice from the local Health District.
