19.04.010 Purpose.

The purpose of this chapter is to establish a comprehensive site plan review process which ensures compliance with adopted plans, policies and ordinances of the Town. It is further intended to provide for the examination of development proposals with respect to overall site design and to provide a means for guiding development in a logical, safe, attractive and expedient manner. 19.04.020 Applicability.

A site plan review and approval in accordance with WMC Title 16 shall be required prior to issuance of a building permit in the following circumstances:

A. New Construction. The requested permit will authorize construction of a new building or other structure in commercial, air park, industrial business park, institutional, or multifamily residential housing in excess of four (4) units per building or two (2) buildings per site.

B. Expansion. The requested permit will authorize, in the zones identified in subsection (A) of this section, the expansion of any building or other structure by more than five (5) percent of its existing floor area, or overall size in cases where floor area is not applicable, or expansion which creates a new dwelling unit, excluding permits for expansion of buildings or other structures located in R-1 single-family zones. 19.04.030 Filing.

Applications for site plan review shall be made on forms provided by the Town and made available at Town Hall. Applicants shall file five (5) copies of said plat and the application must contain all the information and material required under WMC Title 16. [UDC Ord. dated 7/21/1998].

19.04.040 Contents of application and process.

19.04.050 Amendment of site plan.

No approved site plan shall be modified or amended except after reapplication for site plan review and approval by the Town Council; provided, that minor modifications needing the determination criteria established by Town policy may be approved administratively by the Planning Director. 19.04.060 Completion prior to occupancy.

All required improvements and other conditions of site plan approval shall be met prior to occupancy of any site unless required sooner as a condition of approval; provided, that completion and occupancy may be accomplished in phases if approved by Town Council as part of the site plan review process. Incomplete items may be secured by the issuance of a performance bond or other suitable security as a condition of approval of a site plan to secure applicant’s obligation to complete the provisions and conditions of the approved site plan. 19.04.070 Compliance.

After approval of a site plan pursuant to the provisions of this chapter, all development of the property for which a site plan was approved shall conform to the approved site and conditions imposed thereon. The approval of the site plan will expire after a period of twenty-four (24) months if there is no substantial completion of the improvements required by the approved site plan.
