6.10.010 Definitions.

In construing this chapter, except where otherwise plainly declared, or clearly apparent from the context, words shall be given their common and ordinary meaning. In addition, the following definitions apply to this chapter:

A. “Animal” means a domesticated animal, to include dogs or cats that are kept or maintained by an owner or person.

B. “Kept” or “maintained” means performing any of the acts of providing care, shelter, protection, refuge, food or nourishment in such a manner as to control an animal’s actions, or that the animal or animals are treated as living at one’s house by the owner.

C. “Owner” means any person having any interest in or right of possession to an animal. “Owner” also means any person having control, custody or possession of an animal, or by reason of the animal being seen residing consistently at a location, to an extent such that the person could be presumed to be the owner.

D. “Person” means any individual, partnership, firm, joint stock company, corporation, association, trust, estate or other legal entity. (Ord. 666 § 1 (part), 2014)

6.10.020 Cruelty to animals prohibited.

It is unlawful for any person or owner to:

A. Injure or kill any animal by any means causing it fright or pain, or by reason of neglect or intent to cause or allow any animal to endure pain, suffering or injury, or fail or neglect to aid or attempt alleviation of pain, suffering or injury in such a manner not amounting to first degree animal cruelty as defined in RCW 16.52.205 or second degree animal cruelty as defined in RCW 16.52.207, as amended;

B. Confine, without adequate ventilation, any animal in any box, container or vehicle;

C. Tether or confine any animal in such a manner or in such a place as to cause injury or pain, or to endanger an animal, or to keep an animal in quarters that are injurious to the animal due to inadequate protection from heat or cold, or that are insufficient in size to permit the animal to move about freely;

D. Keep an animal in unsanitary conditions and fail to provide sufficient food, water, shelter or ventilation necessary for the good health of such animal not amounting to a violation of RCW 16.52.100;

E. Abandon any animal by dropping off or leaving such animal on the street, road or highway, and any other public place or on the private property of another. (Ord. 666 § 1 (part), 2014)

6.10.030 Penalties.

Any owner or person found violating any provisions of this chapter shall be guilty of a civil infraction and upon conviction thereof shall be punished by a civil penalty of not less than fifty dollars ($50.00), nor more than two hundred fifty dollars ($250.00), per offense. Each day that an offense occurs shall be deemed to be a separate offense. (Ord. 666 § 1 (part), 2014)
