2.10.010 Hiring of officials and employees of the town.

A. Mayor’s Authority. The mayor of the town of Yacolt is hereby authorized to and shall appoint such officers, department heads, and employees for which the town council may generally provide financial remuneration through its budget enactments or other actions from time to time, unless such position is filled or the relevant services are provided pursuant to subsection B of this section. The mayor’s authorization under this subsection A includes, by way of example only and without limitation, the authority to appoint and hire a town clerk, a public works director, an assistant clerk and/or administrative assistant, a public works maintenance supervisor, and additional temporary and/or seasonal employees.

B. Town Council Authority. The town council may approve and adopt contracts and agreements with employees, independent contractors, private businesses, and/or public agencies to provide any services that the town council deems appropriate, valuable, or necessary to the town, pursuant to Washington law then applicable to towns for the procurement of such services.

C. Vacancies. Upon the occurrence of any vacancy in a town office or position, the town council shall determine and direct whether such vacancy will be filled by mayor’s appointment or by contractual arrangement approved by the council. [Ord. 585 § 5, 2021; Ord. 556 § 2, 2016.]

2.10.020 Consolidation of town treasurer and town clerk offices.

A. Town Treasurer and Town Clerk Positions Combined. The office of town treasurer is and shall be combined with the office of town clerk. The office of town treasurer is hereby abolished, and the duties of the town treasurer shall be performed by the town clerk.

B. Effective Date. The consolidation of the offices of town treasurer and town clerk and the abolishment of the office of town treasurer shall be effective three months following the date of publication of the ordinance codified in this section according to law.

C. Termination of Consolidated Offices. The consolidation of the town treasurer and town clerk positions may be terminated by ordinance at any time deemed appropriate by the town council.

D. Retroactive Effect and Ratification of Actions. Notwithstanding any other term of this section, the ordinance codified in this section shall further be given retroactive effect, and shall be deemed to be effective from and after January 1, 2002. Prior acts of the town that are consistent with subsection A of this section from January 1, 2002, to the effective dates of the ordinance codified in this section are hereby ratified and confirmed. 2.10.030 Surety bond required for town clerk.

A. The Yacolt town clerk shall execute a public official surety bond in the penal amount described in subsection B of this section before the town clerk takes office. Such surety bond coverage shall remain in effect throughout the town clerk’s tenure in office.

B. Amount of the Town Clerk’s Surety Bond. The amount of the town clerk’s surety bond shall be $50,000.

C. Form and Conditions of the Town Clerk’s Surety Bond. The town clerk’s surety bond shall be in a penal form; shall be executed by the town clerk as principal and by a surety authorized to execute official bonds and transact surety insurance business in the state of Washington; and shall be conditioned upon the faithful performance of the duties of the Yacolt town clerk in accordance with law and for the faithful payment of all monies which shall come into his or her hands by virtue of said position.

The mayor or town attorney shall approve the clerk’s public official surety bond as to form.

All premiums for such bond, including without limitation initial and renewal premiums, shall be paid by the town of Yacolt, pursuant to RCW 48.28.040.

The town clerk’s surety bond shall be kept on file in the office of the mayor.

D. Town Clerk’s Fidelity Insurance. The Yacolt town clerk shall be covered by a blanket fidelity and faithful performance insurance policy under Yacolt’s insurance program in such amounts and with such coverages as may be determined or approved by the town council from time to time.

E. Amount for Town Clerk’s Fidelity Insurance. The insurance coverage shall be in the amount of $1,000,000 per occurrence, or such other amount as may be determined by the town council from time to time. [Ord. 559 § 2(A), 2017; Ord. 551 §§ 1 – 5, 2016.]
