10.15.010 Speed limits designated.

It shall be unlawful for any person to operate or move any motor vehicle within the corporate limits of the town of Yacolt at a rate of speed faster than 20 miles per hour, or over or across any street intersection within the corporate limits of said town, or within 100 yards of any school house, on school days between 8:00 a.m. and 5:00 p.m., at a rate of speed faster than 12 miles per hour, or in any case at a rate of speed that will endanger the property of another or the life or limb of any person. 10.15.020 Motor vehicle defined.

The word “motor vehicle” shall include all vehicles or machines propelled by any power other than muscular, used upon the public streets or highways for the transportation of persons, freight, produce or any commodity, except traction engines temporarily upon such streets, road rollers or road making machines, and motor vehicles that run upon fixed rails or tracks. 10.15.030 Violation – Penalty.

Any person violating any of the provisions of YMC 10.15.010 or 10.15.020 shall be deemed guilty of a misdemeanor, and upon conviction therefor shall be punished by a fine not exceeding $50.00 or by imprisonment for not to exceed 30 days, or by both such fine and imprisonment. [Ord. 71 § 3, 1923.]

10.15.040 Emergency road conditions – Speed limits.

A. Emergency Declared. It is hereby declared by the town council of Yacolt, Washington, that an emergency exists when, and if, there is ash or dust fallout from Mount St. Helens.

B. Reduction of Speed Limit. In the event of an emergency declared by the mayor which is consistent with this section, the normally posted speed limits of Yacolt, Washington, shall be reduced to 15 miles per hour.

C. Violations. It shall be unlawful for any person to violate the terms of this section when it is in effect. A violation of this section shall be subject to a civil fine not to exceed $25.00.

D. It is hereby declared by the town council of Yacolt, Washington, that an emergency also exists when and if the roads within the town are deteriorating and are in need of repair as to warrant the reduction in speed to 15 miles per hour. This emergency would remain in effect until such a time as to the completion of the road repair and the deterioration of the roads has ceased. [Ord. 246, 1983; Ord. 209 §§ 1 – 3, 1980.]
