8.06.010 Definitions.

For the purposes of this chapter, the following words and phrases shall have the indicated meanings:

(1)    “County road” means every way, lane, road, street, boulevard, and every way or place, or part thereof, in the county of Yakima open as a matter of right to public vehicular travel outside the limits of incorporated cities and towns, which has not been designated as a state highway, and which is regularly maintained and accepted by Yakima County as part of the county road system.

8.06.020 Conduct of Water Upon or Across County Roads.

No person, firm or corporation shall knowingly operate any irrigation system which, in still air, directs water upon or across any county road so as to damage the road or impede or endanger travelers thereon.

8.06.030 Violation – Penalties.

Any person, firm, or corporation violating or failing to comply with any of the provisions of this chapter, upon conviction thereof, shall be punished by a fine in any sum not to exceed three hundred dollars; provided that no person, firm or corporation convicted pursuant to this chapter shall be fined in excess of fifty dollars for a first violation of this chapter.

8.06.040 Damages.

Any person, firm or corporation violating the provisions of this chapter shall be responsible in damages to Yakima County for any reasonable amount necessary to repair, replace, resurface or to otherwise restore such county road as may be affected to the condition in which said road was prior to the act or acts resulting in conviction.

8.06.050 Provisions Supplemental.

The provisions of this chapter shall be cumulative and nonexclusive and shall not affect any other remedy of law.
