16.08.010 Purpose.

A. The purpose of this chapter is to allow the unit lot subdivision process for fee simple ownership of land as an alternative to condominium ownership. Unit lot subdivision applies the dimensional standards in YPMC Title 17 to the overall site, the “parent lot,” while allowing flexibility in the dimensional standards for the subordinate “unit lots.” This section is not intended to permit uses or densities that are not otherwise allowed in the zone in which a unit lot subdivision is proposed.

B. The overall development on the parent lot proposed for subdivision shall maintain consistency with the development standards applicable to the zoning and the land use type at the time the application is vested, as specified by the applicable code provisions and this section. Subsequent additions or modifications to the structure(s) shall not create any nonconformity of the parent lot. (Ord. 768 § 2 (Att. B), 2025)

16.08.020 Applicability.

A. All primary uses that can be developed or proposed to be developed may be subdivided into individual lots pursuant to this section.

B. For previously developed lots, eligibility for unit lot subdivision shall be subject to compliance with all standards applicable to the parent lot and proposed unit lots. Inconsistency of existing development with the provisions of this section shall not constitute justification for a variance under Chapter 17.28 YPMC. (Ord. 768 § 2 (Att. B), 2025)

16.08.030 Dimensional standards.

A. Unit lot Subdivision.

1. A unit lot shall provide a minimum of 10 feet on all sides of a dwelling unit as measured from the outermost point of the structure.

2. A unit lot shall provide a minimum of 20 feet between dwelling units.

3. A unit lot shall have no more than 30 percent structure area.

4. A unit lot shall have not more than 60 percent impervious surface.

5. A unit lot shall be contiguous.

6. A unit lot shall be rectangular to the extent feasible.

7. Setbacks from the perimeter property lines of the parent lot shall conform to the setbacks for the underlying zoning.

B. Zero Lot Line Unit Lot Subdivision.

1. A zero lot line unit lot shall provide a minimum of 10 feet on all sides of a dwelling unit which are not shared with the other dwelling unit.

2. A zero lot line unit lot shall have no more than 30 percent structure area.

3. A zero lot line unit lot shall have not more than 60 percent impervious surface.

4. A zero lot line unit lot shall be contiguous.

5. A zero lot line unit lot shall be rectangular to the extent feasible.

6. Setbacks from the perimeter property lines of the parent lot shall conform to the setbacks for the underlying zoning. (Ord. 768 § 2 (Att. B), 2025)

16.08.040 Requirements.

A. Unit lot subdivisions shall be applied for and processed in the same manner as short subdivisions, pursuant to Chapters 16.12 and 16.28 YPMC.

B. Each unit lot shall meet the requirements of Chapter 16.16 YPMC.

C. Each unit lot shall have individual sewer service, water service, power meter, and other utility connections specific to that unit and shall provide the requisite documentation as outlined in Chapter 16.12 YPMC. (Ord. 768 § 2 (Att. B), 2025)
