10.45.010 Use of golf carts on public streets.

(a) Operation of Golf Carts on Streets Authorized. Any person wishing to operate a golf cart vehicle on a public street must first obtain a permit from the Arena police department. The applicant requesting the permit which shall be indefinite and nontransferable shall pay a one-time fee that shall be from time to time determined by fee schedule resolution of the village board. “Golf cart” means a four-wheeled vehicle commonly designed, equipped and used for golfing. Utility vehicles and ATV type vehicles are not golf carts.

Operation of a golf cart on a public street is subject to the following:

(1) The operator shall obtain the permit required by this section and shall have the permit on his or her person at all times while operating a golf cart.

(2) The golf cart may be operated only on those public streets north of U.S. Highway 14.

(3) Golf carts shall not be operated at a speed in excess of 25 miles per hour.

(4) Golf carts may be operated on public streets each year between April 1st and October 31st and between the hours beginning one-half hour after sunrise and one-half hour before sunset.

(5) Golf carts shall be operated on the far right-hand side of the street.

(6) Golf carts shall abide by all provisions of Chapter 346, Wis. Stats., as adopted herein, except where the context of a provision cannot be reasonably construed as applicable to golf carts.

(b) Inspection of Golf Carts Required. No permit for the operation of a golf cart shall be issued until the golf cart is inspected and approved by the Arena police department. Said inspection shall include the following:

(1) All equipment required to properly operate the golf cart is installed and in good working order.

(2) The golf cart has not been unsafely modified from its condition at the time of production.

(3) The golf cart, if gas powered, has a muffler in good operating condition.

(4) The golf cart has four wheels.

(5) The golf cart has (a) a reflective slow-speed vehicle emblem properly installed at the rear of the vehicle and (b) clear or amber reflective markers on the front of the vehicle.

(c) In order to obtain a permit, the applicant must provide and establish the following:

(1) The applicant is a resident of the village of Arena, is 18 years of age or older and holds a valid Wisconsin driver’s license.

(2) The applicant must provide proof of satisfactory liability insurance specifically providing liability coverage to the operator when operating the golf cart.

(3) The permit issued may include all members of the household of the applicant so long as any such member is able to comply with the provisions of this chapter. [Ord. dated 4/8/20 #3].
