B-2 VILLAGE HIGHWAY COMMERCIAL DISTRICT

18.45.010 Purpose.

The B-2 district is intended to provide an area for those business and commercial activities which especially have to do with motor vehicles or highway transportation, or which provide goods or services primarily to travelers, as a compelling practical consideration, or for which it is especially appropriate for some other reason to be located adjacent to a major thoroughfare or highway. 18.45.020 Permitted uses.

The following uses are permitted in the B-2 district:

(a) Gasoline service stations; provided further, that all gasoline pumps, storage tanks, and accessory equipment must be located at least 30 feet from any existing or officially proposed street line.

(b) Stores for the sale of tires, batteries or other automotive accessories.

(c) Establishments for the washing, cleaning or polishing of automobiles, including self-service car washes.

(d) Establishments engaged in the retail sale of automobile passenger trailers, or campers.

(e) Establishments engaged in daily or extended-term rental trucks, without drivers, or of truck trailers or utility trailers.

(f) Establishments engaged in the daily or extended-term rental or leasing of house trailers, mobile homes or campers.

(g) Hotels, motor hotels, motels, tourist courts, tourist rooms, etc.

(h) Restaurants, lunch rooms and other eating places, including drive-in type establishments.

(i) Commercial parking lots, parking garages, and parking structures.

(j) Tourist-oriented retail shops, including souvenir and curio shops.

(k) Liquor stores.

(l) Sexually oriented businesses as provided for in AMC 18.125.120. [Res. 11-04; Res. 05-04. Prior code § 10-1-30].

18.45.030 Conditional uses.

The following are permitted as conditional uses within the B-2 district. Such uses shall be subject to the consideration of the plan commission and village board with regard to such matters as the creation of nuisance conditions for the public or for the users of nearby areas, the creation of traffic hazards, the creation of health hazards or other factors.

(a) General grocery stores.

(b) Seasonal roadside stands for the sale of vegetables, fruit, or other farm products, but not other types of products or merchandise.

(c) Establishments or facilities for the sale, rental, service, repair, testing, demonstration, or other use of motorcycles, motorized bicycles, go-karts, snowmobiles, aircraft, or other motorized vehicles or their components.

(d) Establishments or facilities for the sale, rental, service, repair, testing, demonstration, or other use of motorboats, other watercraft, marine supplies, motors for watercraft, or their components.

(e) Wholesale merchandise establishments.

(f) Storage buildings and warehousing units.

(g) Motor carrier facilities.

(h) Drive-in and convenience establishments serving food and beverages.

(i) Automobile repair shops, including shops for general mechanical repairs, automobile body repair, and repair of tires, but not including establishments for rebuilding, retreading, recapping, vulcanizing, or manufacturing tires, and not including establishments for painting automobiles.

(j) Establishments primarily engaged in specialized automobile repair, such as electrical, battery and ignition repair, radiator repair, glass replacement and repair, carburetor repair, and wheel alignment service. [Ord. dated 1/7/20 #1; Res. 05-04. Prior code § 10-1-30].

18.45.040 Specifications.

Within the B-2 district the following standards shall apply:

(a) Maximum Building Height

35 feet

(b) Minimum Front Yard Setback

50 feet (80 feet if parking is permitted in the front yard)

(c) Minimum Rear Yard Setback

20 feet

(d) Minimum Side Yard

Principal Buildings

20 feet on each side

Accessory Buildings and Garages

10 feet on each side

(e) Minimum Lot Width (measured at rear of front yard)

80 feet

(f) Minimum Lot Size

0.5 acre
