2.10.010 Nomination of candidates.

Candidates for elective Town offices shall be nominated by a nonpartisan primary election conducted in accordance with the applicable provisions of the Wisconsin Statutes. (2008 code § 1.02(1))

2.10.020 No nominations at Town Caucus.

No candidates for elective Town offices may be nominated at a Town Caucus. (2008 code § 1.02(2))

2.10.030 Nomination at primary.

When the number of those seeking to become candidates for an elective Town office does not exceed twice the number to be elected at the primary, the names of those seeking to become candidates shall be printed on the official ballot for the regular election without there being a primary for that office. When no elective Town office has a number of persons seeking to become candidates which exceeds twice the number to be elected to that office, no primary shall be held if the nomination of elective Town office candidates is the only issue to be decided at the primary. 2.10.040 Spring ballot.

The official spring ballot shall contain only the names of those candidates nominated at the primary and of those becoming candidates because the number seeking nomination for office did not exceed twice the number to be elected. (2008 code § 1.02(4))

2.10.050 Nomination papers.

Those seeking to become candidates for elective Town offices, shall circulate, or cause to be circulated, nomination papers.

1.    Each nomination paper shall contain at the top thereof the following information: The full name (including first and last name and middle initial) and residence and post office addresses of the person sought to be nominated, the title of the office for which nomination is sought, and the date of the primary. No person can become a candidate for or hold any Town office unless he is a resident of the Town of East Troy.

2.    Each nomination paper shall contain at the bottom thereof the affidavit of a qualified elector stating the following information: The affiant’s full name and residence address; that affiant is personally acquainted with all the signers of the nomination paper; that affiant knows they are electors of the Town; that affiant knows they signed the paper with full knowledge of its content; that affiant knows their respective residences given; that affiant knows each signer signed on the date stated opposite his name; and that affiant intends to support the candidate. The affidavit may be made by the person seeking to become a candidate or any qualified elector.

3.    The nomination papers shall be circulated no sooner than the first day of December preceding the election and shall be filed with the Town Clerk not later than 5:00 p.m. on the first Tuesday in January. Signatures shall not be counted if signed and dated prior to the first day of circulation. The nomination papers shall be signed by not less than 20 nor more than 100 electors of the Town. Appearing beside each signature on the nomination paper shall be both the date on which the elector actually signed the nomination paper and the bona fide residence address of that elector. Signatures shall not be counted if signed and dated prior to the first day of circulation.

4.    No elector may sign the nomination papers of more than one person seeking to become a candidate for the same Town office in the same election. In the event an elector signs the nomination papers of two or more candidates for the same Town office in the same election, the earlier signature is valid and the later signature shall be stricken. For purposes of determining the validity of an elector’s signature wherein an elector has signed the nomination papers of two or more candidates for the same Town office in the same election, the date appearing beside the elector’s signature on each nomination paper shall be presumptive evidence of the date on which the elector signed the nomination papers. In the event an elector has signed the nomination papers of two or more candidates for the same Town office in the same election, and it cannot be determined which signature is the earliest, the signature of the elector shall be stricken from all nomination papers for such Town office. Any elector who signs or circulates nomination papers for one person seeking to become a candidate may later circulate, but not sign, nomination papers for a different person seeking to become a candidate for the same Town office in the same election if the elector changes his mind and intends to support the latter person seeking to become a candidate. 2.10.060 Nomination for more than one elective office.

No person may seek, or knowingly permit, his name to be circulated in conjunction with the nomination for more than one elective Town office in the same election. Where nomination papers name the same person for more than one elective Town office in the same election, are filed with the Town Clerk, the Town Clerk shall so advise him, and the person so named shall indicate his preference to the Town Clerk at least 20 days before the primary election. In the event such preference is not timely indicated, the Town Clerk shall allow the name of the person seeking, or knowingly permitting his name to be circulated in conjunction with, nomination for the elective Town office for which nomination papers were first filed. In the event a person is nominated for a Town office in which that person’s name has appeared on the ballot and is also nominated for another elective Town office in the same election by means of write-in ballots, the Town Clerk shall so advise him, and the person so nominated shall indicate to the Town Clerk at least 10 days prior to the regular election that person’s preference as to which Town office their name should appear on the regular election ballot. In the event such preference is not timely indicated, his name shall be disallowed from the regular election ballot for the office for which he was nominated by means of write-in ballots at the primary election. 2.10.070 Notice.

Notice of the nonpartisan primary shall be given pursuant to the applicable provision of the Wisconsin Statutes. (2008 code § 1.02(7))
