8.60.010 Health Officer – Duties and powers.

1.    General Duties. The Health Officer under the supervision of the District State Health Officer shall:

a.    Make a sanitary inspection at least every four months of all school buildings, restaurants, dairies, grocery stores, and meat markets, and places of public assemblage and report thereon to those responsible for the maintenance thereof.

b.    Make a sanitary inspection at least every four months of all school buildings, restaurants, dairies, grocery stores, and meat markets, and places of public assemblage and report thereon to the Town Board and the District State Health Officer.

c.    Promote the spread of information as to the cause, nature and prevention of prevalent diseases and the preservation and improvement of health.

d.    Enforce the health laws, rules and regulations of the State Board of Health, the state and the Town, including the laws relating to contagious diseases contained in Wis. Stat. Ch. 252.

e.    Take steps necessary to secure prompt and full reports by physicians of communicable diseases and prompt and full registration of births and deaths.

f.    Keep and deliver to his successor a record of all his official acts.

g.    Make an annual report to the State Board of Health and to the Town Board and such other report as they may request.

2.    Materials and Supplies. The Health Officer shall have authority to procure at the expense of the Town all record books, quarantine cards and other materials needed, except such as are furnished by the State Board of Health. (2008 code § 11.01)

8.60.020 Rules and regulations.

The Town Board may make reasonable and general rules for the enforcement of the provisions of this chapter and for the prevention of the creation of health nuisances and the protection of the public health and welfare, and may, where appropriate, require the issuance of licenses and permits. All such regulations shall have the same effect as ordinances and any person violating any of such regulations and any lawful order of the Board shall be subject to a penalty as provided in this code. 8.60.030 Health nuisances.

1.    Defined. A health nuisance is any source of filth or cause of sickness.

2.    Duty to Abate. The Health Officer and the Town Board shall abate health nuisances pursuant to Wis. Stat. § 254.59, which is adopted by reference and made a part of this section.

3.    Subject to Forfeiture. Any person who shall maintain or cause a nuisance after being notified to abate such nuisance shall be subject to a forfeiture as provided in this code. (Ord. 2014-5 § 1; Ord. 2011-5 § 1. 2008 code § 11.03)

8.60.040 Regulation of offensive businesses.

1.    Permit Required. No person shall conduct within the Town any business which has a tendency to create a public nuisance, except upon permit issued by the Town Board and subject to such conditions as the Board may impose.

2.    Definition. A business which has a tendency to create a public nuisance is one which unless properly regulated may create the condition creating a public nuisance as defined in Chapter 8.05 ETMC. (2008 code § 11.05)
